All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jacqueline Wilkerson jgwilkerson@embarqmail.com October 7, 2009, 8:29 am Written: 1840 Orange County North Carolina Book 28, Page 511, 512 George Roberts to William Ward Tr State of North Carolina ) Orange County ) This Indenture made & entered into on the 22nd day of February 1840 Between George Roberts of the County of Orange & State aforesaid of one part & William Ward of the County of Orange & State aforesaid of the other part Witnesseth that whereas the Said George Roberts is justly indebted to G W Brown in the Sum of Twenty one Dollars & Sixty Nine Cents & To Brown & Winston in the sum of Twenty Eight Dollars Sixty five cents due by two notes with Int From 22d February 1840 and whereas the said George Roberts being anxious & honestly desirous to Secure the payment of the aforesaid Debts Now Therefore this Indenture Witnesseth, that for & in consideration of the Sum of One Dollar in hand paid by the said William Ward the recpt of which is hereby acknowledged, Therefore hath given granted & sold & doth by these presents give grant bargain sell alien & convey unto the said William Ward the following property (viz) One tract of Land on which I now reside containing One hundred acres adjoining the Caswell County line Charles Steward & Shadrick Ward & others One Bay Mare Saddle & Bridle, One Cow, one set Black Smith tools, one pot two tables In Special trust & confidence, Witnesseth that he the said William Ward shall hold keep use & apply the same to the uses & interest following and no other that is to say, that if the aforesaid Debts and evry part thereof, together with the Lawfull interest that may have accrued on the same, shall not be fully paid off & satisfied on or before the 22d day of August next [?] & in that case it shall be lawfull & shall be the duty of the said William Ward after having advertised the same at three or more public places in said County for the space of ten days, to proceed to Sell the same to the highest bidder for ready Money, and convey the same by proper assurance to the purchaser, and out of the proceeds Money, arising from the Sale of said property retain all the necessary expences of this trust & then pay off & discharge the said debts & Int or such part thereof & shall remain unpaid at the time of said sale the overplus if any he shall truly & faithfully return to the Said George Roberts or his Order.
