All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jacqueline Wilkerson jgwilkerson@embarqmail.com October 7, 2009, 8:25 am Written: 1843 Orange County North Carolina Book 30 Page 198, 199 George Roberts to Martin Warren Tr Roberts to Warren This Indenture made & entered into this 3d day of April 1843 Between George Roberts of the County of Caswell & State of North Carolina of the one part & Martin Warren of the County & State aforesaid of the Second part and Henderson Smith of the third part, Witnesseth that whereas the Said George Roberts Stands justly indebted to the said Henderson Smith in the Sum of Twenty two Dollars as will more fully appear on reference to a certain bond or note bearing even date with these presents, And whereas the Said George Roberts is honestly desirous to Secure the payment of the Said Debt Now therefore this Indenture Witnesseth, that for & in consideration of the premises together with the further consideration of the Sum of One Dollar to the said George Roberts paid by the said Martin Warren the recpt whereof is hereby acknowledged in full the Said George Roberts doth Warrant bargain & Sell unto the said Martin Warren One Blk & White Cow One White Yearling, All of my hogs Six in Number & one hundred acres of Land lying & being in the County of Orange N Carolina upon the head waters of Hyco & Staggs Creek To his heirs Executors Administrators & assigns in fee simple forever free & discharged from any & all incumbrances whatever, In Special trust & confidence Nevertheless tht is to say that if the aforesaid Debt & every part thereof together with the lawfull interest that may accrue thereon shall not be fully paid off & satisfied on or before the 5th day of this month then & in that case it shall be lawfull & shall be the duty of the Said Martin Warren being thereunto re[?] by the said Henderson Smith having first advertised the Same at Brice Collins Mill and William Corbetts & at three other public places in the neighbourhood for the space of 30 days to proceed to sell the said property aforesaid to the highest bidder for Cash & out of the money arising from such sale first release all necessary expenses of this trust & then pay off & discharge the Debt aforesaid due H Smith & the overplus if any pay to the Said Geo Roberts or his Order In Testimony wehereof the Said parties to these presents do hereunto Set their hands & seals this the date first above written witness J H Wiley ) George Roberts (seal) J W Owen ) Martin Warren (seal) H Smith (seal) State of North Carolina) Caswell County ) The Execution of the foregoing Deed of trust was duly proved before me A Slade Clerk of the Court of Pleas & quarter Sessions for Caswell County on the 3d day of April 1843 by the Oath of John H Wiley one of the Subscribing Witnesses thereto, let the same be registered A Slade Clk Registered in Book 77 page 613-1843 A M Calpin PR State N Carolina The Execution of this Deed was duly proved by the oath of T W Owen a Subscribing Witness there to before me Clerk of Orange County Court of Pleas & Quarter Sessions Let it be registered J Taylor CC To hand 6th June 1843 A Mickle PR 7 June 1843 File at: http://files.usgwarchives.net/nc/orange/deeds/warren437dd.txt This file has been created by a form at http://www.poppet.org/ncfiles/ File size: 3.8 Kb
