I Phoebe Clancy of the Town of Hillsborough and the State of North Carolina do make and publish this as my last will and testament, hereby revoking all other wills made by me: I give and devise to Rosannah Thompson colored woman all my right and title to the House and land attached to it, which my sister Frances Thompson by her will devised to her, lying on the south bank of the Eno River. I hereby devise and confirm to all persons, all lands, which they have bought from my sister Frances Thompson, and have paid for, and have deeds for. I also confirm all sales and contracts of sales, of land, which she made, where the title has not yet been completed, upon the parties fulfilling their part of the contracts. I devise and dedicate to the Public, as a public road, twenty feet wide, the road leading from the head of the ravine on the Raleigh Road at Judge Manly’s westward to Thompson’s Mill, on the Chapel Hill Road. I give and devise to Edward Cooley, infant son of Charles S. Cooly the ground which his father bought from me on the North East corner of my Town Lot at the price of $125 – but has only paid me $25, and I revoke the sale not having made him a deed, and he is to release to Edward all his claim to said lot as a condition of this devise. I give and devise to my nephew Walter A. Thompson all the residue of my property of every sort real and personal; and I earnestly enjoin it upon him so to use it, and keep it, that it may afford him a comfortable support for the remainder of his life. I appoint my friend William A. Norwood executor of this my will and I give him full power to sell at public or private sale any portion of my estate real or personal, which can be *** conveniently spared (in case it shall be necessary to sell anything) in order to carry out, and settle up, either my own estate or that of my sister Frances Thompson deceased. In witness whereof I have hereunto set my hand and seal this 1st day of June 1870. Phoebe Clancy (her mark) Signed sealed and published in the presence of, Witnesses W. G. Norwood Thomas Webb I Phoebe Clancy being of sound mind do hereby revoke in my will above the appointment of William G. Norwood as my executor in consequence of his removal from this State; and I do hereby appoint Thomas Webb of Hillsborough my executor with the same authority and power given in my will to said Wm G. Norwood. I do also add to the clause of my said will in fourth item, in favor of Edward Cooley, as is therein written. And in all other respects I do confirm and republish the said will with this codicil to be my last will and testament.
