I Lysias Durham of the County of Orange and State of N.Carolina being weak in body but of disposing mind and memory. do make and ordain this to be my last will and testament in man[n]er and form following First my will is that all my Just debts be paid Item I give and bequeath to my two daughters Tabitha Gear and Mary Jane the south end of my lands including all of my houses and woodlin land[woodlands] enough to keep it up Item I give and bequeath to my son David and daughter Susannah the balance of my lands North of my dwel -ing house to be Equally divided betwixt them so as David to have where he now lives I want the line run so as Each one to have and Equal shear in said lands Item I give and bequeath to my son Tarleton in room of land a two horse waggon ready for the road and a horse worth sixty dollars. one bed and furniture Item My will is that all of my Negroes be hired out until my daughter Mary Jane comes of age and then to be Equally divided betwe[e]n my Children Tabith[a] G. David, Dudley, Susannah L. Tarleton and Mary Jane, so as Mary Jane to be made Equal with the rest of my Children with what is coming to her from her Mothers estate after her raising [page 2] and schooling is paid out also I give unto Item My daughters Tabitha and Mary one bed and furni -ture apiece a cow and calf apiece, horse and saddle apiece the horse worth a hundred ["apiece" x-out] Dollars each also a table and Chest apiece and the balance of my property to be sold and Equally divided among my children above named Lastly I constitute and appoint my friends Wilson Atwater and Manly Snipes Executors of this my last Will and testament In witness where of I do here unto set my hand and seal this Fifth day of September one thousand Eight hundred and thirty seven Signed sealed published and declared by the said Lysias Durham the testator as his last will and testament in the presence of us who were present at the time of signing and sealing thereof Attest { R. Poe Jurat { Arthur Durham Orange County February Term 1838 The Execution of the foregoing last Will and testament of Lysias Durham deced. was duly proved in open Court by the Oath of R C Poe one [of the] subscribing Witnesses thereto and ordered to be recorded At the same time Manly Snipes one of the Exer. therein named appeared in Open Court and qualified Accordingly Test Additional Comments: Will Book Volume F, pages 3-4 Recorded Feb 1838 Estate Papers comprise seven pages and are found in a folder labeled "Durham, Lysias (1838)". No family history found, although there are many entries in the accounts of "hire of negroes", none are listed by name.
