All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume F, pages 50-51 Written: March 26, 1839 Recorded: May 1840 Testator: Eupehence Kerr I Euphence B Kerr of the county of Orange and State of North caro lina being of sound mind and memory but considering the uncertainty of my earthly existance do make and declare this my last will and testament in manner and form following that is to say first that my Executor (hereafter named) shall provide for my body a deasant burial suitable to the wishes of my Relatives and friends and pay all funeral expences together with my Just debts howsoever and to whomsoever owing out of the moneys that may first come into his hands as a part of parcel of my estate Item I give and devise to my beloved daughter Eliza Jane Kerr one bed bedstead and furniture my chainey[china] ware to be equally divided between my two daughters Eliza Jane and Susan also one flax wheel to Eliza Jane also one olde trunk Item I give and devise to my daug[h]ter Susan Kerr one bed and furniture Item I give and devise to my son Samuel Kerr one tin trunk that all the residue of my estate after taking out the devises and legacies above mentioned shall be sold and the debts owing to me all collected and if there should be any surplus over and above the payment of debts and expen ces and legacies that such surplus shall be equally divided betwen my children in equal proportions share and share alike to them and each and everry of them there[sic] executors administrators and assigns absolutely forever I hereby invest my executors with full authority to dispose of all my land at publick sale for the benefit of my heirs I will also that my daughters have there[sic] proportionable parte at the age of eighteen the boys at twenty one years of age I do hereby appoint my trusty friends Samuel Kerr and James Whitsett my lawfull executors to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same [page 2] and everry part and every clause thereof hereby revoking and declaring utterly void all other will and testaments by me heretofore made in witness whereof I the said Euphence B.
