Will Book Microfilm Written: February 7, 1811 In the name of God Amen, I Matthew McCauley of the County of Orange and State of North Carolina being of perfect mind and memory and knowing that it is appointed for all men once to die, do by these present Constitute and appoint this, my last will and testament in accordance form following: First, my soul to God who gave it and my body to be decently buried and my just debts paid, afterward my whole Estate real and personal to be given in manner of form following: Item: I do leave unto my wife Martha the home Plantation whereon we now live with the Mill and one new _____ and two horses and side saddle and bridle, two cows and calves, her choice of my hog stock, also two negroes by the name of Isaac and Nell. Also her bed and furniture of her own choice, also one waggon and gears, also ______ _______ ______ until her death or marriage. Item: I do give and bequeath unto my son John McCauley all that land called ______ _______ And Hogans tract – adjoining him with one negro boy by the name of Samuel. Item: I do give bequeath unto my son Charles McCauley the following tracts of land, Haywood Tract by name and Owens and Pettys tracts by name and one horse, two cows, two sows and pigs The second choice of my stock. Also one negro woman named Nance and one bed, furniture and Fifty dollars. Item: I do give and bequeath unto my son William McCauley the following tracts of land by their names. Blackwoods tract and Johnstons tract and Crabtrees tract with a lot at the University, also one negro Boy by the name of Charles, also one horse saddle and bridle and two cows and calves and two sows and Pigs and one bed and furniture. Item: I do give and bequeath unto my son George McCauley the following tracts of land by name Connaly tract and Rigsby tract and Perrys tract and James tract and one horse and saddle and bridle and two cows and calves and two sows and pigs and one bed and furniture and one negro boy named Dave. Item: Now my will is at my wife’s death or marriage, I do give and bequeath unto my son Matthew McCauley all and every tract that I lend unto my wife, that is to say my home Plantation, Mill with every thing else that I lend my wife. I also give my son Matthew one horse and saddle and bridle, one bed and furniture, two cows and calves and two sows and pigs, also one negro girl named _______. with the plantation working tools. Item: I do give and bequeath unto my daughter Jenney one negro girl named Luce. Item: I do give and bequeath unto my daughter Martha one negro girl named ____________. Item: I do give and bequeath unto my daughter Elizabeth one negro girl named ____________. Item: I do give and bequeath unto my daughter Ellender one negro named Rachel and one horse Saddle and bridle, one bed and furniture, two cows and calves and two sows and pigs. Item: Now my will is that all the remainder of my household furniture that I have not given away and allotted unto my beloved wife plenty of provisions _____________________to raise and support my children __________ that live with her. Item: Now my will is if it should so happen that if any of the negros that I have given to the youngest children, that is to say George, Ellender and Matthew should die before they come of age that either of them that loses their negro should take choice of the remainder of my negros that I have not willed away. Item: Now my will is that if either of my sons should die before they come of age for all the part to be sold and equally divided between my four daughters, Jane and Patsy and Elizabeth and Ellender. ___________ they marry and have heirs, then the heir have it. I do lend my sheep and geese to my wife until her death or marriage to raise and support my Children upon and then I give them to my son Matthew. Item: Now my will is that all my negroes and all my estate of whatever part remains be sold and equally divided between all my children. In order to put this my last will and testament into effect, I nominate and appoint my close friends George Johnston and John McCauley Jr. to act for me and in my name to do and perform as I have here set forth to them. ____________ whereupon I set my hand and affirm my Seal this seventh day of February 1811 Matthew McCauley Signed, sealed and delivered In the presence of us to be the last will and testament Wm.
