This file was contributed for use in the USGenWeb Archives by: Jacqueline Tilley Wilkerson jwilkerson@visionet.org ==================================================================== Book H, Page 157, 158 I Francis Roberts of the County of Orange and State of North Carolina being of sound memory, but considering the uncertainty of my Earthly existence do make and declare this my last Will and Testament, in manner and form following, that is to say - First - That my Executor (hereinafter named) shall provide for my body a decent burial, suitable to the wishes of relations and friends and pay all funeral expenses together with my just debts, however and to whomsoever oweing out of any moneys that may first come into his hands as a part or parcel of my Estate. Item: I give and devise to my daughter Candace two hundred and eight seven acres of land & one half which is the tract whereon I now live originally known as the Henry Horton tract of one hundred and seventy seven acres, and the James Walker tract adjoining the last named tract of about one hundred and ten acres, to have and to hold to her the said Candace Roberts for and during the term of her natural life, and at her death, the same to go to my son Andrew J. Roberts to have and to hold to him and his heirs forever I also give and devise to my said daughter Candace all of my household and Kitchen furniture two milch cows and one horse to be selected by her and a sufficiency of provisions and produce of what I may have on hand at my death for her support and maintenance for one year. Item: I give and bequeath to my daughter Sarah wife of Logan W. Umstead the sum of five hundred to be paid by my executor within three years from my death out of any moneys belonging to my Estate not otherwise disposed of to be hers and at her disposal forever, Item: My will and desire is that all the residue of my Estate after taking out the devises and legacies above mentioned shall be sold and the debts owing to me collected, and the same to be distributed to my son Andrew, my daughter Sarah the wife of L.W. Umstead, my grand daughter Anna Eliza the daughter of my deceased son Willie J. Roberts and to my grand son Dewitt Holt Roberts the son of my deceased son Dewitt C. Roberts each to share and share a like to them and each of them their executors and administrators and assigns forever, Item I direct that my Executor shall be allowed to use his own best discretion in the selling of my property either at public or private sale as he may think best for the interest of my estate and that he shall have three years to dispose of said property if he should think best, And lastly I do hereby constitute and appoint my trusty and affectionate son Andrew J. Roberts my lawful executor to all intents and purposes to execute this my last will and Testament according to the true meaning and intent of the same, and every part and every part and clause thereof, thereby revoking all declaring void all other will and Testaments by me heretofor made, In Witness whereof I the said Francis Roberts do hereunto set my hand and seal. This the 31 day of October 1870.
