I give and devise to my beloved wife Jane Tinnin all this tract of land on which I now live, containing some seventy six Acres more or less, including my dwelling house, all out houses and other improvements, to have and to hold to her for and during the term of her natural life. I also give and bequeath to my beloved wife Jane Tinnin all my stock of Horses, Cows, sheep Hogs; and all the farming implements, wagon, and all the household and kitchen furniture, all the crop of every description that may [page 2] be upon the plantation whereon I now live, and all the provision on hand at the time of my death. My will and desire is that my beloved wife Jane Tinnin shall have and hold all my personal & real estate, (after all just debts are paid) for the term of hir natural life, and at her death to be equally divided among my children that may then be unmarried My will and desire is that when one of my children shall marry that they receive a portion of my estate equal with those that are now married. My true will and desire is that my beloved wife Jane Tinnin have and hold all property of which I die possessed, and use it for her benefit and for the benefit of my unmarried children that are now living with me in my house; that is for the family to remain together and live in common as during my lifetime and should one of my children marry, he or she is to have an equal portion with those of my children that are now married I give and bequeath to my oldest son Robert Tinnin one shot gun, as his right and property forever. I give and bequeath to my son William C Tinnin One Cow and Calf, to be selected by my beloved wife Jane Tinnin. [page 3] I give and devise to my oldest son Robert Tinnin; at the death of my beloved wife Jane Tinnin; the tract of land whereon I now live including dwelling house and all other out houses and improvements to have and to hold to him and his heirs in fee simple forever My will and desire is that my daughters Nancy Jane, Catherine and Paulina have a home on the place on which I now live as long as they may remain single and be provided for as during my life time I give and bequeath to my Daughter Cornelia wife of Gabrian[?] Cheek[?] one dollar :- This is all I have to give her, as I give her her equal portion of my estate when married I give and bequeath to my Daughter Eliz- abeth, wife of George Miles, one dollars[sic], which with the portion I gave hir when married makes her equal with my other Children I do hereby constitute and appoint my beloved wife Jane Tinnin, my lawful executrix to all intents and purposes, to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof - hereby revoking and declaring utterly void all other wills and testaments by me made In witness whereof I the said David Tinnin [page 2] do hereunto set my hand and seal this the 25th February 1858 His Test David (+) Tinnin (seal) Benja.
