All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume F, pages 301-302 Written: August 16, 1838 Recorded: Aug 1846 Testator: Margaret Wall In the name of God Amen I Margarett Wall of the Town of Hillsboro County of Orange and State of N.Carolina being of sound and disposing mind and memory do constitute and ordain this my last Will and Testament in manner and form as follows First I request all my Just debts to be Paid as soon after my decease as possible Secondly I give and bequeath to my Grand daughter Sally Wall daughter of my son William Wall twenty five Dollars if she servive me Third I give and bequeath to my Grand son Wm Wall twenty five Doll[ars] Fourth I give and bequeath to my Grand Daughter Peggy Rider fifty Dollars to her and her Heirs forever Fifth I give and bequeath to my daughter Catherine Wall one half of the residue of my estate And my Negro man Henry should She die without a Child or Children or leeve a last Will and Testement in writing The Property hereby given to her to de[s]cend first to my daughter Nelly Humphrey[Hershey?] should she servive her and in case of her death to her children then living But it is destinctly understood that Allen Humphrey is to have no control over any Part of it or that it is in any way liable for any of his debts Sixth The remaining half I give [page 2] to my friend D[r]. O. F. Long in trust for the use and benefit of my daughter Nelly Hershey also that portion given by the Fifth clause of this my will bequeathed to my dau ghter Catherine of It should fall in is like- -wise to be considered as a devise in trust for my daughter Nelly no part of which is to be under the controul of her Husband Allen Hurshey or in any way liable for any debt he may owe Seventh; The House and lots where I now live is bequeathed equally to my daughters Catharine and Nelly And if Catherine does not choose to live with Nelly The occupier of The House shall Pay annually to Catha rine twenty five Dollars a year during her life. It is distinctly to be understood that Allen Hershey[?] is to have not controul over the House & lots I further direct that in case the trustee hereby appointed should fail to act or die or resign that the County Court of Orange Shall appoint a Trustee who shall have all the Power and authority as if appointed by myself Signed sealed and Published as my last Will and Testament this 16 day of August 1838 Teste her James Webb Margarett (W) Wall (seal) Charles S. Long was appo= inted admr. with the Will annexed who entered into bond in the sum of $2000 with Richard Ashe & Andrew Mickle sureties and qualified accordingly Test Additional Comments: Will Book Volume F, pages 301-302 Recorded Aug 1846 Estate Papers comprise five pages and are found in a folder labeled "Wall, Margarett (1846)". No family history found.
