All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Will Book Volume A, pages 131-134 Written: July 31, 1771 Recorded: unknown date Testator: Nathaniel Walton [Will Book Volume A, page 131] Be it Remembered that I Nathaniel Walton of the Parish of Saint Matthews on the Waters of Enoe in Orange County North Carolina hath this day Considered it being the Thirty first day of July Anno Dommony One Thousand Seven hundred & Seventy one that a will was Proper to be made my Body Being Low and Weak although my understanding Comprehends the Signification of this my Last will and Testament [Will Book Volume A, page 132] I Promis[e] my Just Debts to be paid According to the Specimen of Our Just Laws ~~~~~~~~~~~~~~~~ Secondly I do bequeath unto my Bosom friend and Loving wife Mary one feather Bead and all its furniture two milch Cows Kept for hir will freely without Cost free Tolaration[sic] to Pass Live and Repass Through my House in which I am now Live to the End of hir Days ~~~ Likewise I will and allow hir one Good Hackney Horse Mare or Geldin to be at hir hole Disposal and Command upon Said Premises four Hogs or Swine She shall or may Keep with Tolaration a few Geese Ducks hens &c not Exceeding Six of Each Sort Grown or to be wintered Shee shall have a Privilege if any thing should happen during hir widowhood on acct of Disturbances a House built on the owners Cost of said Land that I now Possess filling to Live in with Twenty Acres of Land adjoining the Big Road and the same shall take in and admit the Spring head might the Big Road she shall have one pick of flax seed sowed Each Year during hir widowhood if require regularly she shall have sufficient fire wood drawn to her Dower when she orders it be lade down also she shall have five pound p annam paid to hir Yearly and Every Year ~~~ [Will Book Volume A, page 133] During hir widowhood on the Twenty Seventh day of Novmbr Each Year Provided never the less that if my wife Mary above written mentioned or Intended to be mentioned Marrys She shall have hir five Pound P annum during Life and by hir to be disposed when She Lists ~~~ Thirdly my Daughter Mary shall and I do will and bequeath that she shall ~~ have a feather bead and furniture two milch Cows and forth Pounds Paid in one Year after She becomes to the Years of Twenty one further more I will and Bequeath to my Young Daughters Viz ~ Jemima and Keziah the Same Consubstantially with My Daughter Mary fourthly and Lastly I will and Bequeath to my only Son now Living Peter Walton all my Land holds and Buildings situate on Enoe in this ~~~ Province of North Carolina County of ~~~ Orange to him his heir and Assigns for Ever also tis by this my will Consti[t]uted[?] that my wife Mary and my son Peter be an him hereby Ordain my Executors to this my Last will and Testament Given under my hand and Seal the Day and Year above written ~~~~ his Sealed pronounced and Nathl. John Reeves Lancelet Johnston [Will Book Volume A, page 134] But further Known to all men this Codical to my will is Such that Every Slave and negro that I have now in possession shall be Submissive and Obedient to my Beloved Mary Walton they and Every of them faithfully Truly and Honestly Obey hir Call and Ordered in all and Every Request during hir ~~~ Widowhood Moreover if my Exr, Sees Cause to Sell one or more of my Slaves Either on on Acct. of Silfish willfull Disobedience in the whole or Either of them or an acct. of Discharging the Legacies as before Insirted Put down and written after the whole of this my Last will and Testament is duly Observed faithfully Compleated and fullfilled my Sone Peter shall have all my Negroes or the Residue of Stock Land and every thing Else now or may be mind here after in full Clear and Absolute possession to Dispose of as his Clear Right and title unless some unknown Legacies that Perhaps may now be or be here after if such be [x-out] now or be hereafter it shall be Equally Divided be tween my wife and Children as witness my hand and Seal this fourth Day of August 1771 Test his Wm.
