First I give and bequeath to my wife Rebecca Ward one bed and furniture, and all of my Household and Kitchen furniture, except what I shall hereafter give to my daughter Nancy Ward, also two milk cows and one calf the first choice, also my two horses, Jack and Tom, also ten head of Hogs the first choice, also five head of Sheep, the first choice, also my Waggon and Gear, also my Carryall and Gear, my plough Gear and all my plantation tools and farming utensils, ten barrels of old Corn and Seventy five Barrels of new corn, Seventy five bushels of Wheat, also two Stacks of oats and three stacks of Hay, also I give and bequeath to my wife Rebecca the whole of the tract of Land on which I now live bounded on the North by William Ward and James Williams, East by Luke Ward, South by Stephen Ward & James Bird West by James Bird & Annah Ward, Containing One hundred and eighty Acres more or less, to have and to hold during her natural life. and after her death I give it to My daughter Nancy Ward forever. and I will that at the death of my Wife all of the property which she may have at the time shall be sold to the highest bidder at public Sale (except the land above mentioned) and the proceeds to be equally divided amongst my children Viz: Stephen Ward William Ward John Ward, Bazzley Ward [page 2] Chaney Ward and Nancy Ward. Second, I give and bequeath to My daughter Nancy Ward One Bed and furniture, one Spotted Cow and three hundred Dollars in Money, and at the death of My Wife. I give to her the tract of land Mentioned above, Containing 180 Acres More or less, known as the "Home Tract" to have and to hold forever. Third. I give and bequeath to my Son Stephen Ward two hundred and twenty dollars Fourth. I give and bequeath to My Son William Ward two Dollars. Fifth. I give and bequeath to My Son Bazzley Ward the tract of land on which he now lives known as the "Faucett tract" containing 96 Acres, also I give to him the tract of land on which John Hessee now lives, Known as the "Fitch Tract", Containing 95 Acres, but before he shall have a good right and title to the two Said tracts of land last Mentioned he shall pay over or Secure to My Son William Ward the Sum of one hundred Dollars and in case he refuses to pay to William Ward the Said sum of one hundred Dollars, then he shall not have a right to the Said Land, but if he will pay to William Ward the Said Sum of one hundred Dollars then shall he have And hold the two said tracts of land forever, free from the claims of any one whatsoever, also I give to My Son Bazzley Ward one note which I hold on him for Seventy six Dollars and interest from Jany 1st 1852 Sixth I give and bequeath to My Son John [page 3] Ward Three hundred dollars in Cash. Seventh. I give and bequeath to my daughter Chaney Ward, the tract of Land Known as the Eckles tract, adjoining the lands of William Ward, James Scott James Williams and Alfred Ward, Containing thirty Seven and one half acres more or less to have and to hold forever. also I give to her two hundred and twenty five dollars in Cash. Eighth; I give and bequeath to each of my Grand children Viz Bedford Hessee. Archy Hessee and Marshall Hessee, the Sum of one hundred Dollars to be paid to each of them by My executors when they shall become of age. Ninth I will that my Executors shall Sell to the highest bidder on twelve months credit, all the balance of my property, not named above, Consisting of Corn, Wheat, Rye, Oats, Hay &c &c and the proceeds be so divided as to give to My wife one hundred and fifty Dollars, and the balance of the proceeds of said Sale to be equally divided among My children Viz Stephen Ward, William Ward, John Ward, Bazzley Ward Chaney Ward and Nancy Ward, and one share to be divided among my three Grand children Viz Bedford Hessee, Archy Hessee & Marshall Hessee. Barnwell } Orange County Court August Term 1855 The Execution of the foregoing last Will and Testament of James Ward was duly proven in open Court by the oath of Luke Ward one of the subscribing witnesses thereto and ordered to be Recorded and filed as such.
