I Nancy Ward of the County of Orange and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthley existance, do make and declare this my last Will and Testament in manner and form following that is to say. First - That my Executor, shall provide for my body a decent burial suitable to the wishes of my relations and friends, and pay all funeral expences together with my Just debts out of the monies that may first come into his hands as a part of parcel of my estate. Secondly I give and bequeath unto my daughter Martha Elizabeth Ward all of my property, both personal, and real. Thirdly It is my wish and desire that if my daughter Martha Elizabeth Ward should die ["before she becomes" x-out] ["of age" x-out] and without bodily Issue before she arrives at the age of twenty one years ["of age" x-out]. that all of the property belong -ing to her at the time of her death, be equally devided among and betwe[e]n the living Children of my Sister Chaney Ward. Fourth - It is my wish that my Sister Chaney Ward, shall take my daughter Martha Elizabeth Ward, to live with her Chaney Ward until my daughter shall arrive at the age of twenty one years. ["old" x-out] Fifth - It is my will and desire that my brotherinlaw Alford Ward is hereby constituted and appointed guardian of my daughter Martha Elizabeth Ward to have and to hold the custody and guardian ship of her estate until the said Martha Elizabeth Ward, shall arrive at the full age of twenty one years. [page 2] Sixth - I do appoint my brother in law Alford Ward executor to this my last will and Testament In witness whereof I the said Nancy Ward do hereunto set my hand and seal this 7th day of February A.D. 1867 Nancy Ward (seal) Signed, sealed, published, and declared by the said Nancy Ward, to be her last will and testament in the presence of us who at her request and in her presence do subscribe our names as witnesses thereto S.
