I John Whitaker of the County of Orange and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner & form following. That is to say First my executor shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses to gether with my just debts howsoever and to whomsoever owing out of the moneys that may first into his hands as a part of parcel of my estate. Item. I give and devise to my wife all of my property during her natural life, with the exception of our bed and bureau I give to Polly McAdams for waiting on her [granary or granny], my wife and executors can sell such property that she has no use for. Item 2 It is my desire at my wife’s death, what perishable property there is on hand, money included, shall be equally divided between my daughters Rachel Tate and Becky McAdams by sale or other wise. Item 3 I give and bequeath to Levi McAdams sons, John & Lyfte [Lylte] at my wife’s death (provided they keep her in firewood and do her milking all of my land to be equally divided between John and [Lylte or Lefte] .. And lastly I do hereby appoint George W. Tate and Levi McAdams my lawful Executors. In witness whereof, I the said John Whitaker do hereunto set my hand and seal this 16th day of January 1884 John Whitaker (Seal) signed, sealed, published declared by the said John Whitaker to be his last will & testament in the presence of us who at his request and in presence do subscribe our name as wit- nessess thereunto. This January 16th 1884 James Gill } Samuel Gill} Witnesses North Carolina} Superior Court Orange county} April 19th 1885 Be it remembered that a paper writing purporting to be the last will & testament of John Whitaker late of said county, is exhibited in open court by Levi McAdams and George W. Tate the executors named therein and having been proven by the oath & examination of James Gill and Samuel Gill the subscribing witnesses thereunto. It is adjudged that said paper writing and every part thereof, is the last will and testament of said John Whitaker and as such it is ordered to be recorded.
