All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume E, pages 508-509 Written: July 11, 1833 Recorded: Nov 1837 Testator: David White In The name of God Amane I David White of the County of Orange and State of North Carolina being Weak in body But of Sound mind and memory Bles[s]ed be almity God for the Same but Knowing that it is appointed for all men ownse to Die ~~~ Do Make and Publish this my last Will and Testement in mannar and form following That is to Say ~~~ 1st I give and bequeath to my beloved wife Betsey one Negro man named Edmond about 32 years old also one Negro girl by the name of Mary about 17 Seventeen years old To be hirs During hir natural Life and then To Dispose of them as She may think Best I also give to my Wife Betsey the Plantation ["whare" x-out] Whareon I now live With all the land that I now Possesess[sic] during Hir natural life and after hir Death 2nd I give and bequeath the Plantation whareon I now live With all the land that I now Possess To my Grand Son David White Kerr also one Negro man by the name of Westley about Twenty Two years old also one Negro woman named Nill about fifty Two years old also one negro Girl by the name of Cate ~~~ 3rd I give and bequeath to my Grand Daughter Margret Graham Kerr one negro Girl named Ann about fifteen years old also one othe[r] Negro Girl named Susey about Thirteen years old also one negro Girl named Jane [page 2] 4th I give and bequeath to my Sun in law Samuel Kerr one Negro man named Harry about Twenty nine years old also one Negro man by the name of Jordan about Twenty fore[sic] years old also one negro girl by the Name of Liza about Twenty years old ~~~ 5th I give and bequeath to my wife Betsey all the Property That I now Possess not above mentioned and To Dispose of as She may think Best Lastly It is my will that if my Grand Son David Kerr should die without a lawfull hair begoten in Wedlock by the said David W Kerr ~~ then the Property willed to him to go to his Sister Margret and if Margret G Kerry sho[u]ld die with out Issue or off Spring forom[sic] her own Body then the Property willed to hir to go to hir Brother David W Kerr It is further my will and wish that if David W Kerr and Margret G Kerr sho[u]ld Both Die without Issue or la[w]full hairs off Springs of thare owne Bodys then and in that Case it is my will and wish the Property Willed them Sho[u]ld be Equely devided betwe[e]n Fany White Daughter of Samuel White and John Maben Allen Sun of Alex Allen And I hereby make and appoint my Sun in law Samuel Kerr and my Brother in law Alex Allen Executors to this my last will and Test[a]ment In Witness I the Said David White have have[sic] Set my hand and Seal and Publish this to be my last Will and Testement Sighn[sic] Seal'd and Published in the Present of of[sic] the Subscribing Witnesses on this the 11th the 11th July 1833 David White (seal) Witnesses James A Craig } Saml. Was duly proved in open Court by the Oaths of James A Craig & Samuel Tate the subscribing witnesses there to and ordered to be recorded ~~~~ At the same time Samuel Kerr one of the Executors therein named appeared in open Court and qualified Accordingly Test Additional Comments: Will Book Volume E, pages 508-509 Recorded Nov 1837 No estate papers found.
