Bacon one of the subscribing witnesses and by B. M Lockhart as to the handwriting of J.P. Lockhart one of the subscribing witnesses who is dead. Orange County, North Carolina W.T. Bacon being duly sworn deposes and says that … is a subscribing witness to the paper writing now shown …purporting to be the last will and testament of Richard Whitted deceased: that the said Richard Whitted in the presence of this deponent and in the presence of J.P. Lockhart who has since died subscribed his name at the end of said paper writing by making his mark on that – affirmed – attested it in the presence of and at the request of said Richard whitted and that at the time of the execution of the said paper writing said Richard Whitted was in his opinion of sound mind and disposing memory and capable of making a will. E.M. Lockhart being duly sworn deposes and says that J.P. Lockhart one of the subscribing witnesses to the paper writing now shown him purporting to be the last will and testament of Richard Whitted deceased, is dead and that he is well acquainted with the handwriting of said J.P. Lockhart having often seen him write and that the name of said J.P. Lockhart subscribed as a witness to said paper writing is in the genuine handwriting of said J.P. Lockhart. …..sworn to and W.T. Bacon subscribed before me this October 31,1917 E.M. Lockhart Chas. Strayhorn C.S.C. And thereupon it is considered and adjudged by the Court that the said paper writing and every part thereof is the last will and testament of Richard Whitted deceased and it is ordered that the same together with the foregoing examination and this certificate be recorded and filed This October 31, 1917 Chas. State of North Carolina} February 12th 1910 Orange County } To all whom it may concern, I Richard Whitted of the county of Orange in the state of North Carolina being of sound mind do hereby make this my last will and testament. I give and bequeath to my daughter Minnie Whitted three acres of land lying and being on the west side of my land next to John Richards land and after my decease if she should desire to sell the said three acres of land it is my will and desire that she give my son John Whitted the opportunity to buy the said three acres before offering the said land to any other persons. It is further my will and desire and do hereby give and bequeath to my son John Whitted the residue of all my property both personal and real estate to have and to hold forever.
