All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume D, pages 553-555 Written: January 19, 1819 Recorded: Feb 1819 Testator: John Wilborne In the name of God Amen, I John Wilborn[sic] of the County of Orange and State of North Carolina being of sound mind and memory but weak in body, do make, ordain, constitute, and establish this my last Testament and Will in manner and form and form[sic] following, that is to say -- 1st my will is that all my Just debts be paid 2st[sic] I give and bequeath to my wife Mary Wilborne all my Lands wher[e] I now live during Her natural life. also the following Negroes Stephen, Jeremiah, Samuel and a negro woman named Janne[Janie?], also the two first choice of Horses also the preasant stock of Cattle, also my Household and Kitching[sic] firneture, togather with my plantation tools, also fifteen Head of sheep her ch[o]ice. all the above during her natural life 3th[sic] I give and bequeath to my wife Mary Wilborne one negro Woman named Feedy[Feeby/Phebe] to her and her Heirs forever also two Beeds and firneture, for ever -- 4th I give and bequeath unto Duran Hampton (Daughter of Noland Hampton) one negro girl named Silvy to her and her Heirs forever 5th I give and bequeath unto Alvis Hampton (son of Noland Hampton) one negro boy by the name of Nathan to him & his Heirs forever. 6th I give and bequeath unto Noland Hampton (son of Noland Hampton) one Negro boy by the nam[e] of Thomas to him and his Heirs forever 7th I give and bequeath unto Noland Hampton Senr. my stud Horse Firetail also one Negro man by the name of Step[h]en (After my wife's death) to him and his Heirs forever- 8th I give and bequeath unto my brother Richard Wilborne three Negroes Viz Dick, Phillis, and little Bett to him and his Heirs forever. 9th I give and bequeath Robert Wilborne (son of Richard) one little Firetail filly to him and his Heirs forever. 10th I give and bequeath unto Lewis Wilborne Daniel, Betsey, and there[their] two children Daniel and Nat to him and his Heirs forever also a negro boy named Sam (after my wife['s] death) to him and his Heirs forever - also I give and Devise unto my brother Lewis Wilborne all my lands whereon I now live (at the Death of my wife) to him and his Heirs forever-- 11th I give and bequeath unto [my] brother Edward Wilborne fifty cents 12th I give and bequeath unto [my] brother Zachariah Wilborne fifty cents [page 2] 13th I give and bequeath unto each of my brother Thomas Wilbornes Children each fifty Cents - 14th I give and bequeath unto my sister Temperance Marshal one negro woman named Vilet and her child Lucy also one negro girl named Amy to her and [her] heirs forever 15 I give and bequeath unto my sister Susanna Ledle Jones two Hundred dollars to her and her Heirs forever 16 I give and bequeath unto my sister Lida Slaughter two Hundred Dollar[s] to her and her Heirs forever 17th I give and bequeath unto my friend Roland Cook one Hundred Dollars to him and his Heirs forever 18th I give and bequeath unto my friend John Hampton son of my wife one Hundred Dollars 19th my will and desire is that the moneys ariseing from the sale of my estate and the moneys on hand, and debts due me, are by my Executors to be kepd out on Intrust in good and safe hands - and the above moneys and Intrust at my wifes Death to be equally devided between my brothers and Sisters except Edward Wilborne, Zachariah Wilborne, and my brother Thomas Wilbornes children them or eyther of them to have no part 20th and for the faithful performance of my negro woman named Janne and her son Jeremiah my wish and desire is at the death of my wife that the said Jeremiah and Janne be emancipated and set free also I give and Devise unto my man Jeremiah one track of Land containing one Hundred Acres aJoining Roland Cook Samuel Cary and others - also one horse colt call[e]d Dyon one Cow, one Sow & pigs, to him and his Heirs forever - 21st a[l]so my wish is that the preasant crop be finish[e]d before any division of the negroes take place - 22nd I nominate and appoint my friends Thomas Bennehan [page 3] Benjaman Bullock and Nathaniel Carrington executors to this my last Testament and will and I do hereby revoke all others by me made here to for I[n] testamony hirof[sic] I here unto set my Hand and Seal this 19th January Eighteen Hundred and nineteen.
