Viz. ~~~~~ First, It is my Will that my Funeral expences and all my Just debts, be first paid.~~~~~ Item, I give and bequeath unto my beloved Wife, Elizabeth Wilkinson, the third part of the land, with the use of the House I now live in, during her life; with one horse, bridle, and saddle of her choice; two cows and calves, and five sheep, with all the Household furniture, which she may think needfull for her use. Also two beds and bedding. (Item) I give to my oldest son Thomas Wilkinson, that part of the land he now lives on to the dividing fence west of his House, with the horses, and cows, in his possession. ~~~~~ (Item) I give to my son John a ceartain piece or parcel of land, lying in between me and [my] son Thomas, a line to be run, to start at a large rock at the gate, thence by a large gum tree, to Hughs line; a part of this land as much as one Acre, to remain for the whole use of the foundery. I also give to my aforesaid son John Wilkinson, one horse, saddle, and bridle, one cow and calf, one bed and bedding. ~~~~~ [page 2] (Item) This part I now live on to be divided between William and Samuel, a line to be started inside of the fence le[a]ding to John, at an Apple tree, thence to run a little north of West, to the Creek; I also give and dispose of one Horse, saddle and bridle, one cow and calf, one bed and furniture, to each of these two herein named, When these lots are run off and valued, he thats gets the most valuable, to pay over to the others, to make them equal. ~~~~~ (Item) I give and bequeath to my Daughters, all the money that I ["they" x-out] now have on hand; with the whole of my stock of cattle and sheep, not disposed of before, with the whole of my household furniture not otherwise disposed of, to be equally divided among them all, also one Horse, saddle, and bridle to each of them. ~~~~~ I do constitute, make and ordain, my sons Thomas Wilkinson and John Wilkinson, Executors of this my last Will and Testament; and I do hereby utterly disallow, revoke, and disannull all and every other Testament, Wills leagues[legacies] bequests, and Executing, by me any wise before made, Willed, and bequeathed, ratifying this and no other, to be my last Will and Testament; in Witness whereof I have hereunto set my hand and seal, this twentieth day of December in the year of our Lord one thousand eight hundred and forty two Signed, sealed, and Acknowledged { Daniel Wilkinson (seal) by the said Daniel Wilkinson, { his last Will and Testament, { in the presence of us, who { Exrs qualified [page 3] in his presence, and the presence of each other, have hereunto subscribe our names. ~~~~~ Samuel McCracken Jr Allen Brown State of N.C. Orange County Feb'y Term 1842 This paper writing having been offered for probate in open Court as the last will and testament of Daniel Wilkerson deceased, Allen Brown was duly sworn and made oath that he was a subscribing witness to the same that he signed it as a witness in the presence of the said Dan: Wilkerson, who published & declared it to be his Will & was then in a sound & disposing state of mind -- And Saml N. Tate being duly sworn stated that the name of Samuel McCracken jr which is signed to the same as a witness is in the property hand writing of said McCracken & that said McCracken is now dead. J.
