All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume B, pages 22-25 Written: June 18, 1787 Recorded: unknown date Testator: William Williams I William Williams being at Present Indisposed and the life of man very Uncertain do hereby Set- tle the Affairs of this world in the following man[n]er I desire that six Hogsheads of Tobacco due to me by John Taylor of Hil[l]sborough, be sent as Soon as may be to Misses Gilmour Black & Amis Merchants in Halifax agreeable to my Engagement in Part payment of my Bond given them ~~~ I Bequeath to my son William my Lands in the western part of this State Consisting of three thousand Eight Hundred & forty Acres the Same being the Lands granted to me by the State of North Carolina for my Services as a Captain in the Continental Line of this State, and I do hereby direct my Executors to Reserve for my Said Son William my Silver mounted sword & also my Riding Furnature[sic] and wearing apparel of every Denomination I bequeath to the sole use of my son William to be Either Sold or Retained for his use at the Discretion of my said Executor as to them may seem most Expedt. & Advantageous I also direct that the Tuition & Cloathing of my son be Committed to the Sole Care of his Mother, the same to be at her Expence Suitable to his Station in life & in propor- =tion to the Bequests hereafter to be made to her, or to the Estate that Shall Remain in her hands after the payment of all my Just Debts, as may be Directed by the Common Guardian of Orphans in case of aney neglect in my Said Executors, and it is hereby my Will that if my said Son [page 2] William Should die Incapacitated to Convey ~~~~ Real property or without having Lawful Issue that the Lands and Every Other Species of property hereby Deavis'd Shall Revert to my Wife Elizabeth if she Survives him but if Otherwise to go to my Brother Samuel Williams & in case of his death to his son William Williams All the Residue of my Real and Personal Estate I Bequeath to my wife Elizabeth to be at her Sole & Absolute Disposial Still Subject [to] the Payment of my Debts & to the Edu= =caton of my Son as heretofore Recited more parti= =cularly I Bequeath to her A piece of Land which I purchased from Jacob Richards in Orange ~~ County: my house and Lott in the town of Hil[l]sborough Purchased from Geo Hoskins with the Accruing Rent for the Presant[sic] Year Com[m]encing the 22d Day of Last March ~~ A Bay Horse Called Powel and two Cows &c Also my Stock in trade and and[sic] All Species of Provisions & Liquors now on hand with All my household Furnature and Utensils of what kind or Nature soever, Including all manner of House Linen Beds Blanketts and Coverlids: I Bequeath also to my wife the Commu= =tation Due to me As an Equivalent for my half Pay as a Continental Afficer, if it Should be her Choice to Accept of that in Preference to Sd. half Pay which I allow to be at her obtion[option] if Consistant with the Rules of Congress and the Laws of this State ~~~ I Disire that two Bay mares I own may be sold and the money arising therefrom to be Appli[e]d towards the ~~ [page 3] Payment of my Debts, also my Executors to Sell any other Species of Property as may be necessary to Effect that Purpose ~~~ I Direct that all my estate Real and Personal may be Valude by two Judiceous men appointed by my Executors, and A Schedule of the Same lodged in the County Court of Orange ~~~ Finally I do hereby Bequeath to my wife all and Every Species of Property I may Die Possess'd of which has not Been Already Deavised by this my last will and Testament, namely all Debts due to me by Bond note or Book Acct. and all of my other Intrests which apertains to me & I hereby Appoint my wife Elizabeth & George Doherty [x-out] my Executors and Guardians to my son under the Comptrole of Chancerry[sic], till he arrives at the Age of Chusing one for himself Dated 18th Day of June 1787 Sign'd ["Seald" x-out] and Wm.
