All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume E, pages 28-29 Written: February 27, 1821 Recorded: Nov 1822 Testator: James Woody Be it known that I James Wood of the County of Orange and State of North Carolina being of sound and disposing mind and memory calling to mind the uncertainty of life and the necessity of settling and adjus ting my worldly concerns in a manner agreeably to my self, so as to prevent unnecessary trouble, and expen ces after my death, do constitute and ordain this to be my will and Testament in manner and form following 1st I Will that all my just debts be paid by my executors as soon after my decease as the situation of my affairs will admit 2nd I give and bequeath to my beloved wife Mary Woody fifty (50) pounds Cur[r]ency of this state, half the grain that is in hand, and half the grain that may be growing at my decease, the bay mare, her saddle and bridle, one bed and firniture (her choice) fifty acres of land, including all my buildings two cows (her choise) ten head of hogs, and forage sufficient for said stock the ensuing winter, all of which I will and bequeath to her, her heirs, and assigns for ever, except the land which is my will that she shall have the use of no longer than she continues my widow 3rd I give and bequeath to my son Hugh, one third of all ["except the last entry lying and adjoining" x-out] my land, wich I will to him, his heirs, and assigns for ever; on condition, that he pay into the hands of my executors the sum of fifty (50) dollars [page 2] 4th I give and bequeath to my son Samuel half of the remaining part of my land lying and ad joining on the river and upper end of the plan tation to him his heirs and assigns forever, on con dition that he pay into the hands of my execu tors the sum of fifty (50) dollars 5th I give and bequeath to my son John the rem aining part of my land and the fifty acres that is willed to his mother after the expiration of her wi dowhood, to him his heirs and assigns forever provid ed he pay into the hands of my executors the sum of fifty (50) Dollars 6th I give and bequeath to my daughter Charity forty (40) Dollars, and to Susana ["15" x-out] fifteen Dollars 7th I give and bequeath to Mary McCan the sum of forty (40) Dollars, Bed and furniture 8th It is my will and desire that the residue of ["cattle" x-out] of my goods and cattles[chattels], be sold, and the wh ole of personal estate ["not" x-out] herein, be equally di vided, between my wife and daughter Viz Sara, Mary, Rebecca, Charity, Hannah, Susana, Jane, Ruth, and Eleanor 9th I will that my three son Hugh, Samuel and John have the care of my Daughter Charity she not be ing in a situation to have the care of herself I will that one hundred and fifty Dollars (50) [sic] Be equally Divided between the girls Lastly I continue and appoint my twos[?
