All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ben Franklin ben.franklin.ffru@gmail.com May 2024 Source: Loose Will, NC Archives CR 073.801, Will Book Volume D, pages 538-539 Written: January 28, 1813 Recorded: Aug 1818 Testator: Edward Wortham Be it remembered that I Edward Wortham of Orange County & State of North Carolina being in perfect health mind and memory thanks be given unto God Calling unto mind the mortality of my Body, & knowing that is appointed for all men Once to die, Do make this my last Will & Testament and as tuching Such worldly estate wherewith it has pleased God to bless me with in this life, I give Demise and Dispose of the same in the following manner & form, (Viz) First it is my Will that my funeral expences & all my Just Debts be first paid ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Item I give & bequeath unto my Beloved wife Mary Wortham all my Estate both real & personal for ever, only what I shall hereafter other wise Dispose of to my Children ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Item I give & bequeath unto my Daughter Elizabeth Wilson all that she got from me when She left me Also One Dollar to my said Daugh[t]er forEver Item I give & bequeath to my Son Charles Wortham all that I gave him when he left me, to have the same for ever, I give my said son Charles my Negro Man Oliver during my said sons Natural life ~ ~ ~ ~ ~ ~ ~ ~ ~ Item I give & bequeath unto my Daughter Sarah Hall one Mare Called & Known by the name of Nell, for ever ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Item I give & bequeath unto my son William Wortham all that he got from me when he left me, & my whipsaw also my Negro Man Oliver at the Death of my son Charles, I give to my said son Wm. for Ever ~ ~ ~ ~ ~ ~ Item I give and bequeath unto my Daughter Nancy Wilson all that She got from me when she left me, Also Ten Dollars to my said Daughter for Ever, Item I give & bequeath unto my son John Wortham all that I gave him when he left me, also One Negro Boy Called & known by the Name of Edmond now in his possession, I give to my said son John Wortham for Ever ~~~ Item I give & bequeath unto my son James Wortham all that he got from me when he left me & One Negro Boy called & known by the name of ~~~~ Benjamin now in his possession & One feather bed & furniture I give to my said son James for Ever ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Item I give & bequeath unto my son Alfred Wortham the plantation ~~ whereon I now live Called & known by the name of the Walker Tract, [page 2] and Containing one Hundred Acres be the Same More or less, to have full possession one year after the Death of Mrs Sarah Dunnagan, also I give to my said son Alfred One Negro Boy called & known by the name of Sawney[Lawney] at the Death of his mother Mary Wortham & one feather bed & furniture I give to my said son for Ever ~ ~ ~ ~ Item I give and bequeath to my Son Samuel Wortham all that Tract or parcel of land whare Mrs. Sarah Dunnagan Now lives Containing Three Hundred Acres be the same more or less to have full possession at the Death of his mother Mary Wortham I also give unto my said son One Negro Girl Called & known by the name of Biner & her Increase, to have possession of her & her Increase at the Death of his mother Mary Wortham, I give to my said son Samuel fore ever, also One Bed & furniture &c ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ I do constitute make & ordain my beloved wife Mary Wortham & my son Samuel Executrix & Executor of this my last will & Testament and I do hereby utterly disallow revoke & disannul & and[sic] every other former Testament wills, legacies, bequests, Executrix & Executors by me in anywise before mentioned, willed, & bequeathed, Ratifying; & Confirming this & no other to be my last will & testament In Witness whereof I have hereunto set my hand & seal this Twentieighth day of January Eighteen Hundred & thirteen. ~ (1813) ~~~~~~~~~~~ Signed, sealed, published } pronounced, and Declared } by the said Edward Wortham } Edward Wortham (seal) his last will & testament, in the } presence of us, who in his presence } and in the presence of each other, } have hereunto, subscribed, our names. } Joseph Armstrong } Peggy Armstrong } Jurant Saml Wortham quld.
