Original in possession of Sue Guptill State of North Carolina } Pamlico County } This deed made this the 10th day of October AD 1901 by and between Hardy T. Casey, Guardian for Chas. E. Casey, Hardy J. Casey and Bertha Alice Casey of this county of Pamlico and State of North Carolina of the first part and Victoria J. Baxter of the aforesaid county and state of the second part. Witnesseth, whereas in a judgement of the Superior Court of Pamlico County at Fall Term 1901 Judge Francis D. Winston presiding, In an action then in entitled Hardy T. Casey and others Ex parte, the said Hardy T. Casey was empowered and duly authorized to make sale of the following discribed lands and to execute to the purchasers a deed in fee simple therefore, and to invest the proceeds of said sale and purchase in another tract of land described in the petition filed in the above named actions, and to take a deed therefore for the heirs at law of Alice Casey wife of Hardy T. Casey that the same interest title and estate might vest in the said heirs, as they held in the lands devised to them by their Grandfather Tulley Spruill n his will which will is duly recorded in the office of the Superior court Clerk of Pamlico in Book of Wills pages 83, 84 and 85, to which as well as the petition and judgement in this case herein before named reference is made for the purpose of affecting the chain of title and the title to the lands herein conveyed. Now then for and in consideration of the sum of Four hundred and Thirty one 25/100 in hand paid by the said party of the second part the receipt whereof the said party of the first part Hardy T. Casey Guardian as aforesaid does hereby acknowledge as fully paid and received and by nature of the powers granted unto him by the aforesaid judgement authorizing him to sell said hereinafter discribed piece parcel or tract of land. The said Hardy T. Casey Guardian as aforesaid has given granted bargained and sold and by these presents and does give grant bargain sell and convey unto the said Victoria J. Baxter her heirs and assigns forever in fee simple absolute all that piece or parcel of land devised to the said heirs of Alice Casey by the said will of Tully Spruill. Situated on the head of Aligater Creek in the said county and state adjoining the lands of Ellen Gatlin and others bounded as follows. Beginning at the line of Ellen Gatlins land and runs with her line to the line of Jas. O. Baxter lands then with the aid Baxters line to the Gaskins line, then with said Gaskins line t Ellen Gatlins line thence with her line to the beginning containing Twenty Six acres more or less. To have and to hold all the right title and interest of the said Chas. E. Casey Hardy J. Casey and Bertha Alice Casey in and to the said lands together with all the rights privileges and appurtenances thereunto belonging unto the said Victoria J. Baxter her heirs and assigns forever in e simple absolute, and the said Hardy T. Casey Guardian for said children does for them covenant they will forever warrant and defend the the title to said lands and the peaceable and quiet possession thereto against all lawful claims of all persons whatsoever. In witness whereof the said Hardy T. Casey as guardian aforesaid has hereunto set his hand and seal this the day and date first herein written. Signed sealed & delivered H.T. Casey in presence of North Carolina Pamlico County The execution of the foregoing instrument was this day proven before me, by the acknowledgement of H.T. Casey, the grantor.
