Ferebee and wife Rebecca Ferebee of Pamlico County and State of North Carolina of the first part to Mary Jane Appleby, Anna Appleby, and Florence Appleby of Pamlico County and State of North Carolina of the second part: WITNESSETH, That said S.W. Ferebee and wife Rebecca Ferrebee, in consideration of One hundred Dollars, to them paid by the said Mary Jane Appleby and Anna and Florence Appleby the receipt of which is hereby acknowledged hath bargained and sold by these presents doth bargain, sell, and convey to said Mary Appleby during her natural life and at her death to Anna Appleby and Florence Appleby in fee simple absolutely and jointly and to their heirs and assigns a certain piece or parcel of land in Pamlico County, State of North Carolina adjourning the lands of S.W. Ferrebee, Benjamin Barker and others, bounded as follows, viz: Beginning at Jackson street and Fowlers gin Alley and running with Jackson street eighty five ? at right of said Jackson street, westwardly Forty Eight feet thence parallel with Jackson Northwardly Eighty five to Fowlers Gin Alley then with said Alley Eastwardly Forty Eight feet to the beginning containing about 1/4 acre ? same more or less. This deed being executed to the said Mary Jane Appleby in lieu of he dower interest in and to a lot held in common by S.F. Ferrebee and Anna Appleby and Florence Appleby heirs at law of James Appleby, and unto the said Anna Appleby and Florence for their one third undivided interest in the said lot known as the James Appleby lot. The said lot having been sold by order of court for partition n an action before the clerk of the Superior Court of Pamlico County ? S.W. Ferebee against Mary J. Appleby and Anna Appleby and Florence Appleby. TO HAVE AND TO HOLD the aforesaid tract or parcel of land, and all privileges and with the appurtenances thereunto belonging to the said Mary J. Appleby during her Natural life and at her death jointly by Ann and Florence Appleby and others heirs and assigns to their only use and behoof forever. And the said S.W. Ferrebee and wife Rebecca Ferrebee covenant with said Mary J. Appleby, Florence Appleby and Anna Appleby others heirs and assigns, that they are seized of said premises in fee, and hath right to convey the same in fee simple; that the same are free and clear from all incumbrances, and they will warrant and defend the said title to the same against the claim of all persons whatsoever. Ferebee being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or any other person, and that she doth still voluntarily assent thereto.
