MORTGATE DEED _____________________________________________________________________________ State of North Carolina } Pamlico County } THIS INDENTURE made this 2nd day of March in the year of our Lord One Thousand Nine Hundred and Eight between William Long and wife Margaret Long of the county of Pamlico and State of North Carolina of the first part and Victoria J. Baxter of the County of Durham and state of North Carolina of the second part. Witnesseth, that the said parties of the first part, for and in consideration of the sum of One Thousand dollars in hand paid by the party of the second part, the receipt whereof is hereby acknowledged hath bargained and sold, conveyed and confirmed and by these presents do bargain, sell, convey and confirm unto the said party of second part her heirs and assigns forever, all the following described piece or parcel of land lying and being in the county of Pamlico # 2 Township and known and designated as follows. Bounded on the North by Alligator Creek on the East by the lands of Morris Daniels on the South by the lands of Ellen Gatlin and n the West by the lands of Ellen Gatlin. Containing Twenty Six acres more or less & being the lands conveyed in the will of Tully Spruill to the heirs of Alice Casey and described in a deed from H.N. Casey and others to V.J. Baxter and recorded in Book 42 page 271 and also in a deed from Alice Casey and husband and Sophronia Fentress and husband to V.J. Baxter recorded in Book 44 page 202 of records of Pamlico Co. TO HAVE AND TO HOLD the same with all the hereditaments and appurtenances thereunto in anywise appertaining. And the said William Long and wife parties of the first part do covenant with the said party of the second part, her heirs and assigns as follows: First that they are the owner and lawfully seized of said premises; Second, that they have good right to convey the same, Third that the same is free from all encumbrance whatever; Fourth, that the party of the second part her heirs and assigns, shall quietly enjoy and possess the same, that they will warrant and defend the title to the same against all lawful claims. Provided, Nevertheless that if the said William Long & wife Margaret Long of the first part their heirs, executors and administrators, shall well and truly pay, or cause to be paid to the said Victoria J. Baxter, party of the second part, her heirs, executors and administrators or assigns, the sum of One Thousand Dollars according to the condition of eight certain bonds of even date herewith payable Nov. 15, 1903; Nov. 15, 1909; Nov. 15, 1910; Nov. 15, 1911; Nov. 15, 1912; Nov. 15, 1913; Nov. 15, 1914; Nov. 15, 1915. Each bond for One hundred and Twenty Five dollars with interest at 6% per annum then this deed to be null and void, otherwise to remain in full force and effect. But if default shall be made in the payment of the said bonds or the interest, or any part thereof, at the same time herein before specified for the payment thereof then the said parties of the first part, in such case do ______ hereby authorized and fully empower the said party of the second part her heirs, executors, administrators and assigns, to sell the said hereby granted premises, at public outcry at the court house in Bayboro, after first advertising the same in some newspaper, published in Pamlico Co. (if there is a paper published therein, and if none, then to advertise as Sheriffs are required to advertise land sales under execution), and to convey the same to the purchaser in fee-simple and out of the moneys arising from such sale, to retain the principal and interest which shall then be due on the said bonds, together with all costs and charges, including the ten per cent. commissions, and pay the surplus (in any) to the party of the first part, their heirs, executors, administrators and assigns. Long and Margaret Long his wife, personally appeared before me this day, and acknowledged the due execution of the within Deed of Mortgage, and the said Margaret Long being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or any other person, and that she doth still voluntarily assent thereto.
