Pamlico County, NC - Wills - Spruill, Tully - 1879 File contributed for use in USGenWeb Archives by Teresa Kelley SPRUILL FAMILY WILLS TULLY SPRUILL April 24, 1879 I TULLY SPREWELL of the State of North Carolina and County of Pamlico being of sound and deposing mind and memory and knowing the uncertainty of my Earthly existence do make publish and declare this to be my last will and testament in manner and form following and I do hereby revoke all other wills or clauses of wills here to fore made by me first that my executors herein after named shall provide for my body a descent burial suitable to the wishes of relatives and friends and pay all my just debts to whomever owing and of the moneys which may first come into his hands as a part and parcel of my estate Second I give and bequeath unto my beloved son A. K. SPRUILL two tracts of land the first two acres where he now lives running to a dividing ditch between his house and the homestead. The second tract 169? acres on the upper end of the Swamp field on as much as will make it equal with the heirs in the enti?? tract that I am now seized and possessed of to him the said A. K. SPRUILL his heirs and assigns forever Third I give and bequeath to my beloved sons Daniel N. SPRUILL and Johnson SPRUILL one tract of land on the ???? ???? between ??? J. P. REDDING and myself adjoining A. K. SPRUILLs line enough of the said land to contain one forrest of the certain tract to them and their heirs forever. Fourth I give and bequeath to my beloved son James SPRUILL one eighth of the entire tract aforesaid so as to include the dwelling house to him the said James SPRUILL and his heirs and assigns forever. Fifth I give and bequeath to my beloved daughter Victorine? ALLEN wife of Asa R. ALLEN one tract of land beginning in ??? John P. REDEDINGs line and running ????? so as to include one eighth of all the land there I am now seized and possessed of to her and her heirs forever. Sixth I give and bequeath to the heirs of my beloved daughter Mary Eliza GASKINS wife of James H. GASKINS one tract of land situated on the head of Aligator Creek adjoining the GASKINS land containing one eighth of all my lands that I am now seized and possessed of to them and their heirs forever. Seventh I give and bequeath to my beloved daughter Ellen GATLIN wife of Bradford GATLIN ???????? ???? on one eighth of the tract where I now live adjoining Victorine? ALLENs land also 7 1/2 acres on ?????? to make one eighth of the entire tract situated on the head of Aligator Creek adjoining the J. H. NICHOLS land to her the said Ellen GATLIN her and her heirs forever. Eighth I give and bequeath to the heirs of my beloved daughter Alice CASEY wife of Hardy CASEY one eighth of my lands I am now seized and possessed of situated on the head of Aligator Creek adjoining the lands of Ellen GATLIN to them and their heirs forever Ninth I hereby give the cotton gin to the use of the farm or its occupants Lastly I hereby nominate and appoint my beloved son Daniel N. SPRUILL sole executor to this my last will and testament given under my hand and seal this 24th day of April AD 1879. State of North Carolina Pamlico County In the Probate Court A paper purporting to be the last will and testament of Tully SPRUILL deceased is exhibited before me the undersigned Judge of Probate of said County by Daniel N. SPRUILL the executor therein mentioned and the ??? executions thereof by the said Tully SPRUILL by the oath and examination of F.F. CHERRY and by the oath of J.T. SPRUILL as to the handwriting of J.L. BRYAN deceased the subscribing witnesses then to who being duly sworn doth depose and say and each for himself deposeth and sith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Tully Spruill that the said Tully Spruill in the presence of this dispo????t subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date of the 24th day of April 1879....
