Perquimans County, NC - Indenture - Thomas Weeks - 1726 File contributed for use in USGenWeb Archives by Donna Cooper [Ref: Perquimans County, NC., Court Minutes] Nr. 35, North Carolina Ss: This indenture made this fifth day of April in the Year of our Lord one Thousand Seven hundred and Twenty and Six and in the Ninth Year of the reign our Sovereign Lord George the Second by the Grace of God of Great Brittain, France and Ireland King &c. by and between John Parish of the County of Albemarle and precinct of Perquimmons Senr. of the one party and Thomas Weeks of the same place, farmer, of the other party Wittnesseth that the said John Parish for divers good causes and Considerations him hereunto Moving but more Especially for and in Consideration of the said Thomas Weeks paying and discharging the Land Tax of the Land herein Mentioned hath Bargained Sold Aliened Enfeofft Convey and confirmed by these presents doth Bargain Sell alien of Confey and Confirm unto the said Thomas Weeks his heirs and assigns forever one Messuage plantation and Tract of Land Situate lying and being on the South West side of Little River in peequimions pre Acres be it more of less Butted and Bounded as by the said patent is mentioned To have and to Hold the said granted and Bargained Premises with all the appurtenances Privileges and Commodities to the same belonging or in any wise appertaining to him the said Thomas Weeks his heir and assigns forever to his and their only proper use Benefit and Behoof forever and I the said John Parish for me my heirs Executirs and administrs. do Covenant and promise and grant to and with the said Thomas Weeks his heirs and assigns that before the Ensealing hereof I am the true sole and Lawful owner of the above Bargained premises and am Lawfully seized and possessed of the same in mine own proper Right as a good perfect and absolute Estate of Inheritance in fee simple and have it myself good right full power Lawful authority to Grant Bargain sell and Convey and Confirm the said Bargained premises in Manner as aforesaid and that this the said Thomas Weeks his heirs and assigns shall and may from time to time at all times for ever hereafter by force and virtue of these presents Lawfully peaceably and quietly have hold ever hereafter by force and virtue of these presents Lawfully peaceably and quietly have hold use Occupy posses and Enjoy the said Demised and Bargained premises with the appurtenances free and clear and freely and Clearly acquitted Exonerated and Discharged of and from all and all manner of former of other gifts grants Bargains sales Leases Mortgages Wills Entailes Joyntures Dowries Judgements executions Encumbrances and Extents Furthermore I the said John Parish for myself my heirs Executrs. and Administrators do Convenient and Engage the above demised Premises to him the said Thomas Weeks his heir and assigns against the Lawful Claim or demands of any person or persons whatsoever for ever hereafter to Warrant secure and defend in Witness whereof I have hereunto set my hand and Seal the day and Year first above Written John Parish, Senr.
