North Carolina. Ss. In the Name of God Amen. I, Samuel Swann, of the precinct of Pequimans, Esqr., Being Sick and weak of body, but of Sound and perfect mind and memory, praised be God, Do maks, Constitute and Declare, these presents to be and Contain my Last will and Testmt., hereby revoaking and makeing void all former and other wills by me heretofore made or Declared. Imprimis, I Give and bequeath unto my Son, William Swann, an old Bible, and a Seale ring, which was my fathers, in full for his portion, haveing advanced sufficient for him in my life time. Item, I Give and bequeath unto my Son, Sampson Swann, the Sum of five pounds, in full for his portion, having ad- vanced sufficient for him in my life time. Item, I Give and bequeath My Land lying between Muddy creek and Marshey gutt, to my Sons, Henry and Thomas, and their heirs for ever, ye Same to be equally divided betwixt them, and my Son, Henry, to have his first choice. Item, I Give unto my said Sons, Henrey and Thomas, all my Lightwood, that is or shall be pick't up on Grassy pt Land, with reasonable Assistance of my Negroes to help burn ye Same, Also, the use of my Pitch Kettle (if any shall come in), to Boyle ye Tarr. AUso, what Pitch Tarr, as Mr. John Pottiver stands indebted to me by Bill. Item, I Give and bequeath unto my sd. two Sons, Henry and Thomas, All the Goods, that I have sent for from London, to trade with. Item, I Give unto my sd. two Sons, Henry and Thomas, what goods I have perticularly sent for, for their use, vizt., as much Shagathee, Shallon, Buttons & Silk as will make each of them a Suit. Also, 4 Shirts & two muslin Neckloaths apiece. Item, It is my Desire and I Do Earnestly recommend it to my said two Sons, Henry and Thomas, That the produce of the Lightwood and goods, which I have given them, be employed in a Joynt Stock for trade, as being the most likely Course to thrive. Item, I Do Give and bequeath unto my two Sons, Samuel and John, and my two Daughters, Elizabeth and Sarah, All my moneys that is due to me in England by Bills of Exchange or otherwise. And, it is my Earnest Desire and request That my Loveing Brother Richard Bland of Virginia, Esqr, or his Assignes Do Employ ye Same in one Joynt trading stock for the use and proffitt of my said Children; which said trade- ing Stock is to be Carried on Entire till such time as either of my said Children shall marry of Come of age, which shall first happen, then his or her part, to be Delivered to him or her, and ye remainder to be Carried on for the benefitt and advantage of the rest till such time as they shall severally marry or come of age. Item, I Give unto my Loveing Wife, Elisabeth Swann, Fifteen pound per. Annum, out of the proffitts which shall arise of the said trading stock, and to be Allowed the said Richard Bland, or his Assignes upon his Accompts. Item, It is my Will and Desire that the said Richard Bland, Esqr., or his Assignes, Do yearly make up the Accts. of the proffitts of said Stock to my Executrx. hereafter named. Item, I Give and bequeath unto my said Loveing wife, Elizabeth, My plantation whereon I now live, with all the Land and Houses and appurtenances thereto belonging, for and dureing the term of her naturall Life. And after her Decease, I Give Devise & bequeath the Same to my Son, Samuell, his heirs and Assignes for ever. Item, I Give, Devise and bequeath my Land on the Sound side, joyning to Normans, to my Son, John, his heirs and Assignes for ever. Lastly, All the rest and residue of my Estate, I Give, Devise and bequeath the Same unto my Loveing Wife, Elizabeth, whome I make my sole Executrx. for paymt. of my Debts, Legacies, and Christain Education of my Children. In Testimony whereof, I have hereunto putt my hand & Seale, this Twelfth day of September, Anno Dom., 1707. Samuel Swann. Court, holden the .0th. day of Aprile, Ano. Dm. 17. ., the above will was proved by ye Oaths of the Hon'ble Edwd. Mosely & Fran. Foster, Esqr. Test. F. Knight, Secty. No. Carolina, ss. Willm. Glover, Esqr., Presid't of the Council and Command'r in Cheife of this Province. Whereas Good & Lawfull proffs hath bin made of the last will and Tes- tam't of Saml. Swann, Esqr., Deed., a true Coppy whereof is hereunto annexed, and therein hath appointed and made Elizabeth, his wife. Sole Executrix of ye Same. These are, therefore, to Impower the sd. Elizabeth Swann, in and upon all and Singular, the Goods & Chatties, rights and Creditts of the sd. Samuell Swann, to Entor wheresoever 't to be found, and the same into her posession to take, and a true Inventory thereof to returne into the Sectys. Office, within one yeare after ye Date hereof, and ye Same to dis- pose of as by the sd. Will is appointed. Given und'r my hand and ye Seale of this CoUony, this 28th. day of May, Ano. Dm., 1708. W.
