DIVISION OF THE LAND OF JAMES HAMLETT DEC’D In obedience to an order of Person County Court to us directed for the purpose of allotting and dividing the land of James Hamlett decd. Amongst the male heirs of said Dec’d after the widow third was allotted off to her. We the commissioners have --- --- the r------ and whom celebrate ----- have allotted the lands of the said deceased off after said dower was laid off by actual survey in the following manner. To wit: To Thomas Hamlett No 1. Beginning at a white oak corner of Geo. Darbeys line running thence with his line East twenty seven chain to a pine thence South twelve chain to a white oak thence East three chain and fifty links to ---- Joseph ----- corner thence South twenty nine chains and fifty links to a hicory thence South 47 D West twenty nine chains to pointers thence North 10 degrees West fifty one chain to pointers thence North ------(gone) chains and twenty-five links to the first stake containing 138 ˝ acres valued to L103.10 To John Hamlett No 2. Moon?) The above plat represents the division of the land of James Hamlett dec;d amongst his five sons agreeably to an order from Person Court Surveyed 6th day of April 1821. James Rainey surveyor This document was the result of a petition to divide the land Frances Hamblett Received from her husband’s estate in 1793. It is dated 1821. Pursuant to an order from the worshipful court of Person County we have divided the land of the estate of James hamlet dec’d amongst his five sons in the following manner. Robert Hamlett drew lot No 1. Beginning at a pine being the South West corner of the whole tract and running thence North eighteen chains and fifty links to a hicory(?) thence East forty seven chains and five links to a pine on Adderson Hall’s line thence with his line South forty seven degrees West eighteen chains to a stake thence South seven chains and fifty links to a poplar said Halls corner thence West thirty four chains and sixty links the beginning. Containing seventy two acres valued at five dollars per acre amounting to three hundred and sixty dollars. ________ John Hamlett drew No 2. Beginning at a hicory as mentioned in No 1 and running thence North fifty eight chains to a poplar thence East twelve chains and thirty five links to pointers thence South fifty eight chains to a stake thence West thirteen chains and thirty five links thence the beginning containing seventy two acres valued at three dollars and fifty cents amounting to two hundred and fifty two dollars._________ James Hamlett drew lot No 3. Beginning at a stake being the South East corner of No 2 and running thence North fifty eight chains to pointers (as mentioned in No 2) thence East twelve chains and thirty five links to a lightwood stake thence South fifty eight chains to a stake thence West twelve chains and thirty five links to the beginning containing seventy two acres valued at two dollars pr acre amounting to one hundred and forty four dollars. The heirs of John Hamlett drew lot No 4. Beginning at a stake being the South East corner of lot No 3 and running thence North fifty eight chains to a lightwood stake as mentioned in No 3 thence East twelve chains and thirty five links to a stake and pointers thence South fifty eight chains to a stake near a pile of rocks thence West twelve chains and thirty five links to the beginning containing seventy two acres valued at three dollars and fifty cents per acre amounting to two hundred and fifty two dollars. ________ Thomas M. Hamlett drew lot No 5. Beginning at a stake near a pile of rocks as mentioned in No 4 and being the South East corner thereof and running thence North fifty eight chains to a stake and pointers as mentioned in Lot No 4, thence East seven chains and fifty five links to a small hicory on James Hamletts line thence South ten degrees East fifty four chains to a hicory thence South forty seven degrees West six chains to a pine being the North East corner of NO 1, thence West ten chains to the beginning containing seventy two acres valued at four dollars and fifty cents pr acre amount to three hundred and twenty four dollars________ No 1 (Robert Hamlet) will therefor pay to No 3 (James Hamlet) ninety three dollars and sixty cents. No 5 (Thomas Hamlett will pay to No 3 twenty eight dollars and eighty cents. No 5 will also pay to No 2 (John Hamlett) fourteen dollars and forty cents. The petition of Thomas, James, Robert, & John Hamlett, Nancy & John Watson, Elizabeth & John Hamlett heirs at law of Jofes hamlett dec’d humbly -------- to your worship that James Hamlett died in the year 1792 intestate leaving his widow Frances Hamlett and five sons. To Wit: Jofes Hamlett, who is since dead, leaving as his heirs at law Nancy who has in turn married with John Watson , Elizabeth & John Hamlett minors & infants under the age of twenty one years, who petition by their guardian & ----t friend John ------, Thomas, James, Robert & John Hamlett who by the lay(sp?) of land at trial time was (were) entitled to this land of their ancestor as tenants in common to the conclusion of the --------- that the land of this said James Hamlett was equally divided between the five sons aforesaid with the exception of an third which was attached to his widow Frances for life. Frances Hamlett widow of James Hamlett dec’d Of The Estate of James Hamlett __________ " _________ Petition for ------ -------- ------------ STATE OF NORTH CAROLINA We the subscribers being summoned by the sheriff of Person County to lay off and allot unto Frances Hamlett widow and relief (?) to James Hamlett dec’d one third part of all the lands, tenaments & of which her said husband was seized or possessed of at the time of his death. Also to allot and set of to the said widow a childs part of the personal estate of which her husband died possessed. And agreeable to such writ to the sheriff directed. We have not on the premises and after being duly sworn by the sheriff aforesaid have accordingly alloted and lay’d off t the said Frances Hamlett widow as aforesaid one third part of all such lands as her husband dec’d seized and possessed. Containing in the whole one thousand and thirty nine acres which said third part contains three hundred and forty six acres and one third and bounded as follows to wit: Beginning at a large poplar in the branch near a school house on Ruebin Taylors line. Thence his line South seventy five chains and twenty five links to a pine on Tob—y Williams line. Thence his line East thirty four chains to a poplar. Thence North six chains and seventy four links to a post oak. Thence North 47 deg, East about twenty six chains to pointer. Thence North 10 degs West about fifty one chains to pointers. Thence West forty four chains to the first -------- . Containing 346 acres as aforsaid which said land includes the house wherein the said James Hamlett dec’d generally dwelt. Together with all the oak groves on the planatation and which said land houses & whose ---- her into possession agreeable to law in that ------ ------ and provided. We have accordingly allotted unto the said widow the just sum of sixty eight pounds four shillings and eight pence it being the fourteenth part of the account of sales of said estate which amounts to nine hundred one fifty four pounds five shillings and four pence. It also being a childs part of said sales (the personal property being all sold). Which said fourteenth part of sales she is accordingly placed in possession of agreeable to law in that cse made and provided. Given under our hand & seals this 7th day of November ------- 1793.
