FRANCIS DIED AND IN 1821 FOUR OF HER SONS AND THE HEIRS OF A FIFTH APPLIED FOR PERMISSION TO TAKE OVER THE LAND SHE HAD RECEIVED FROM JAMES ESTATE. Pg 2 STATE OF N.CAROLINA Person County September Term 1793 To the worshipful the justice of the county aforesaid this petition of FRANCIS HAMBLET widow of JAMES HAMBLET deceased humbly complaining herewith to your worshipful that her husband JAMES HAMBLET departed this life on the 22nd day of October 1791 without leaving any --?—will or testament or making any provision for your petitioner as widow aforesaid/ leaving one thousand acres of land in the county aforesaid. 100 acres of which said has been cleared cultivated a dwelling house & other outhouses erected t hereon. Your petitioner set forth that the said HAMBLET left personal property to the amount of nine hundred and fifty five pounds 5/lp as appears by a/4 acre of sales returned by your petitioner exec. Administrix of the said estate. Your petitioner begs leave further to state the said left thirteen children. Viz: JESSE ), POLLY, FANNY, THOMAS, JAMES, KITTY, NANNY, MARTHA, LUCY, PEGGY, ROBERT, JOHN & ANNE. Your petitioner therefor prays of your worshipful to grant her your note directed to the sheriff of said county authorizing him to summon a jury of -- ?—as the law in such cases directs. To allot and lay off the real estate o & also such part of the personal estate of her dec’d husband as she is by law entitled to for her dower and that she be put into immediate possession of the same. THE ORIGINAL PETITION WAS SUBMITTED TO THE COURT IN SEPTEMBER 1793 ALSO. IT IS THE SAME MINUS THE WITNESS SIGNATURES. FRANCIS HAMBLETT MADE TWO PETITIONS TO THE COURT FOR THE RIGHT TO GUARDIANSHIP OF ANNE & LUCY HAMBLET (WHO WERE HER CHILDREN ANYWAY) THE FOLLOWING IS THE ONE FOR LUCY. IT IS IDENTICAL TO THE ONE FOR ANNE. Know all men by these presents that we Frances Hamblett, Tobias Williams, Benj. Johnston & Tho M. Hamblett all of the County of Person and State of North Carolina are held and firmly bound unto the justices of our county court of Person and their successors in the just and full sum of six hundred pounds to be paid unto the said justices and their successors and assigns in trust for the benefit of the child hereafter named committee to the L----- of the said Frances Hamblett to which payment is well and truly to be made. We bind ourselves our heirs exec & admin jointly & severally firmly by these presents. Sealed with our seals and dated this 17th day of Sept Annon== 1792. The condition of the obligation is such that whereas the above bounden Frances Hamblett is constituted and appointed guardian to Lucy Hamblett a minor orphan. Now if the said Frances Hamblett shall faithfully execute this said guardianship by securing and improving the estate of the said Lucy Hamblett until she shall attain to full age of all that shall come into her hands or possession for the the benefit of the said orphan or if it should be sooner thereto required and then render a plain and true account her said guardianship on oath before the justice of our said county and deliver up --- to possess all such estate or estates as --- ought to be possessed of(f) or such other person or persons as shall be lawfully authorized and empowered to receive the same and the true profitts arising therefrom then the above obligation shall be void otherwise to remain in full force and effect. HAMLETT STATE OF NORTH CAROLINA We the subscribers being summoned by the sheriff of Person County to lay off and allott unto FRANCIS HAMLETT widow and reliec to JAMES HAMLETT dec’d one third part of all the lands tentaments all of which her said husband was seized or possessed of at the time of his death also to allot and set off to the said widow a childs part of the personal estate of which her husband dec’d possessed. And agreeable to such writ the sheriff directed. We have ---(?) on the premises and after being duly sworn by the sheriff aforesaid have accordingly allotted and lay’d off the said FRANCIS HAMLETT widow as aforesaid one third part of all such lands as her husband dec’d seized and possessed containing in the whole one thousand and thirty nine acres which said third part contains three hundred and forty six acres and one third and bounded as follows to wit: Beginning at a large poplar in the branch near a school house on RUEBEN TAYLORS line thence his line South seventy five chains and forty five links to a pine on to –(?)--- WILLIAM ---(?)-- line thence his line East thirty four chains to a poplar thence North six chains and seventy four links to a post oak thence North 4 deg East about twenty six chains to pointers thence North 10 deg West about fifty one chains to pointers thence West forty four chains to the first --?-- containing 346 acres as aforesaid which said land includes the house wherein the said JAMES HAMLETT dec’d generally dwelt. Together with all the outhouses on the plantation and which said land houses we have put her into possession agreeable to law in that case made and recorded. We have accordingly allotted unto the said widow the just sum of sixty eight pounds four shillings and eight pence. It being the fourteenth part of the amount of sales of said estate which amounts to nine hundred and fifty four pounds and five shillings and four pence. It also being a childs part of said sales (the personal property being all sold) which said fourteenth part of sales she is accordingly placed in possession of agreeable to law in that case made and recorded.
