PAGE 1 State of North Carolina….Person County Know all men by these presents, That we William Oliver, David Hemphill and Obidiah Faulkner are held and firmly bound unto James Trudell Esq, governor in the sum of fifteen thousand dollars to be paid to the said governor, or his successor in Office to which payment well and truly to be made, we bind ourselves, our heirs, executors, and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this seventeenth day of June? 1828. The condition of the above obligation is such, That if the above bounden William Oliver, Dav Campbell ann………. Administraters of all and singular the goods and chattels, rights and credits of Stephen Oliver deceased, do make, or cause to be made a true and perfect inventory of all and singular the goods and chattels, rights and credits of the deceased, which have or shall come to the hands, knowledge, or possession, of the said Wm Oliver or into the hands or possession of any person or persons for him and the same so made do exhibit, or cause to be exhibited, to our said County Court of Person, within ninety days after the date of these presents, and the same goods and chattels, rights and credits, and all other goods and chattels, rights and credits, of the said deceased at the time of his death, or which at any time hereafter shall come into the hands of the said Oliver or into the hands of possession of any other person or personas for him do well and truly administer according to the law: And further do make, or cause to be made, a true and just account of his said administration within the time required by the Act of Assembly after the date of these presents, and all the rest and residue of said goods and chattels, rights and credits, which shall be found remaining in the hands of, or due from the said Administrator shall deliver and pay unto such person or persons respectively, as the same shall become due, pursuant to the true intent and meaning of the Act of Assembly in that case made and provided. And if it shall appear that any Will or Testament was made by the deceased, and the executor of executors therein named do exhibit in the same Court making a request to have it allowed and approved of accordingly, if the said Oliver above bounden, being thereunto required, do render and deliver the said Letter of Administration, (approbation of such Testament being first had and made in the said Court), then this obligation to be void, otherwise to remain in full force and virtue. The condition of the above obligation is such that whereas the above bounden William Oliver Ex of Stephen Oliver Decd. prayed and attained an appeal to the Supreme court to be held for the County of Person in a Judgment of the County Court of pleas and quarter beneficiaries that for the county of Person and this all on day of September 1829 in a suit with Josiah Oliver against him. It was between William Oliver Ex He do well and truly prosecute his own appeal with the effort as is case to be …. And this you shall in no wise omit, under the penalty prescribed by law.
