TO THE SUPERIOR COURT OF PERSON COUNTY, YOUR PETITIONERS RESPECTFULLY SHOW: 1. That, with the exception of JR LONG, RD LONG, JOHN H ZIMMERMAN, JOHN EVANS, JAMES RAMSEY and SCRAP EVANS, who join their respective wives as parties to this proceeding, your petitioners are owners in fee-simple, seized, and in possession, as tenants in common of a certain tract or parcel of land lying in Cumminghams Township, Person County, North Carolina, adjoining the public road leading from Ceffo to Chub Lake on the North, lands of JT JORDAN and JA LONG on the east, lands of WG CLAYTON and SAM EVANS on the south, and the public road leading from Roxboro to Ceffo on the west: Containing by estimation 160 acres more or less. Being the land formerly owned by the late SAMUEL A DIXON. 2 That the interests of the several tenants in common in said land are as follows: JL Dixon, Samuel A Dixon, Lula B Long, Susan Green Long, Sallie B Zimmerman, Joanna T Duncan, Nancey W Winstead, Ella J Evans, John Harris and Charlie Dixon each own an one-thirteenth undivided interest therein; J D Long, J Mac Long, Joe Samie Long, Ella Long and Lula Evans, children of Cinderillan Long deceased, each own an one-sixth of one- thirteenth undivided interest therein; James Evans, Sam Evans, Isaac E Evans and John Evans, children of Ann Evans, deceased, each own an one-fourth of one-thirteenth undivided interest therein: Mary Ramsey, Pat Evans, Lou Evans and Richard Evans, children of Frances Evans, deceased, each own an one-fourth of one-thirteenth interest therein. But the interest of these last is affected by the will of their ancestor, the late Samuel A Dixon, as set out in the following paragraph. 2. That under the last will and testament of the late Samuel A Dixon, the ancestor of these petitioners, your petitioners seriving their title under said will, Frances Evans( she being dead, her children named above) is reauired in order to put her on an equality with the other devisees. So that each full share of one-thirteenth will be entitled to receive, out of the proceeds, excluding Frances Evan's children, the sum of $165, before they are entitled to participate in the division.
