Melton, of county of Person of State aforesaid, being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and Testament in manner and ________following, that is to say, I give _______and bequeath unto my beloved wife Sarah G. Melton all of my property both real and personal of what ever nature and kind and wheresoever the _________shall be at my death. After all of my just debts have been paid to have and to hold so long as she lives. After her death, it is my will that all of the property both real and personal except the Bluewing tract of land be equally divided between all of my children, or their heirs. But David O’Briant not to be considered an heir of Mary Bettie. First Mary Bettie, Stephen H., Sarah J., Margaret W., and Marena C. Melton. And the Bluewing tract of land to be kept for all of my children that may be singe as a home for them as long as they remain single. And Mary Bettie to be considered as one of the single ones. At their death or marriage then the said tract of land to be divided between all the living children or their heirs. They may divide all the property by selling___(or division?)_____ as they think __(proper?)_______. But I want it distinctly understood that David O’Briant is never to have the benifit{sic} of one cent of my property. In writing wherof {sic}I the said William T. Mitchell, Jr. STATE OF NC SUPERIOR COURT A paper purporting to be the Last Will and Testament of William T. Melton deceased, is exhibited before me, the undersigned, Clerk of Court for said County, by Stephen H. Melton, and the due execution thereof by the said William T. Melton ________by the oath and examination of J. T. Yancey and C. H. Mitchell, Jr., the subscribing witnesses thereto; who, being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper-writing now shown him purpoting {sic} to be the last will and testament of William T. Melton; that the said William T. Melton, in the presence of this deponent, subscribed his name at the end of said paper-writing, which is now shown as aforesaid, and which bears the date of the 11 day of March 1885. And The Deponent Further Saith, That the said William T. Melton the testator aforesaid did at the time of subscribing his name as aforesaid, declare the said paper writing to be his Last Will and Testament, and this deponent did thereupon subscribe his name at the end of the said Will as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of deponent’s subscribing his name as an attesting witness thereto, as aforesaid, the said William T. Melton was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent. And further these deponents say not.
