All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Sheila Schmutz sheila.schmutz@usask.ca June 24, 2012, 7:30 pm Source: North Carolina State Archives, Raleigh Nc Written: January 30, 1827 In the name of God, Amen, I Stephen Oliver Senr of Person County & the State of North Carolina being weak in body though of sound mind and memory, knowing that it is appointed for all men once to die do make and ordain this my last will and testament, Improven?, I desire that my burial should be decent without pomp in anyway, I commend my soul to God that gave it, and as for my worldly Estate, after my just debts being paid, I desire to be divided in manner and form following, Informis, I lend to my son Robert one hundred acres of land as designated by Plat during his natural life and my desire is that if he should die without lawful issue, that then it shall return to my other Legatees I also lend to my son Durrett Oliver one hundred acres of land as by Plat specified during his natural life, and should he die without issue my will is that it return to the rest of my lawful heirs, I have deeded to my son William Oliver one hundred and thirty-five acres of land, the thirty-five he paid me for the hundred acres making him even with the rest of my children as to land, I also lend to my son John Oliver one hundred acres of land as will appear from a Plat in my possession during his natural life, should he die without lawful heir, my will is that it shall return as above, I also lend my son Reuben Oliver one hundred acres of land as specified by a Plat that I have in possession on his paying me one hundred dollars which is for the building that is on it, I also lend my son Wright Oliver one hundred acres of land as is specified by a plot during his natural life, and should he die without lawful heir my will is that it return to the rest of my children, I lend my son Stephen Oliver one hundred and fifty acres of land joining the Virginia line to be laid off by a line paroled thereto, during his natural life, should he die without lawful issue, my will is that it return to the rest of my heirs, I also lend to my son Josiah Oliver the residue of any land during his natural life Should he die without issue lawfully begotten of or by him my desire is that it shall return, if there should be any remaining after paying the monies that I am Security for him for, As for the balance of my Estate my desire is that it shall be equally divided among the whole of my children during their natural lives but my will is that if either of them die without a lawful heir, the whole of the property loaned them by me be returned for an equal division among the rest of my children As witness my hand this the thirtieth day of January in the year of our Lord 1827 Stephen Oliver Witness Robt Jones Senr (Inatt?) (On the next page:) Codicil to this my last will, my will is that when any of my Children shall or may have Children that are lawfully begotten Then and in that Case their property I have loaned them shall be theirs in fee simple to dispose of as they please. I desire my Sons Robert Oliver, John Oliver, Stephen Oliver & Josiah Oliver Each to have one bed and furniture to make them Equal with my other children in witness whereof I have hereunto set my hand this 28th day of May 1828 his witness.
