Your petitioners being we the heirs of the said Abraham Tison they therefore pray your worship would by the power and authority in you vested by act of assembly in the like case maid and provided would appoint commissioners according to said act to make partition of the land and division of the personal property among your petitioners and they a in duly bound will ever pray. State of North Carolina To the Sheriff of Pitt County Greeting you are hereby commanded to summon Arthur Forbes, James Randolph, Jessee Randolph, Randall Johnson and Sherwood Hines commissioners to meet on a day by you to be appointed on the the land belonging to heirs of Abraham Tison dec’d then and there to divide the same amongst the legal representatives of said dec’d likewise to divide the personal estate of the dec’d among the legal heirs according to act of assembly and when having so done to make a part of their proceedings to the next term of this court to be held for Pitt County at the court house in Greenville on the first Monday in November ____ ___ _____ _ _______ witness George Evans clerk of our said court the first Monday in August 1802. ???? 19th August 1802 George Evans Clk. Pursuant to an order of Pitt Court August term 1802 us the undersigned commissioners directed to lay off and divide and appropriate the lands of Abraham Tyson dec’d among his legal representatives of said dec’d. We have laid off and divided the land as follows viz Lot No. 1 we have laid off and set apart unto Sarah Joiner wife of Jacob Joiner and daughter of the said dec’d her share in the following manner: Begining at a hicory Benjamin Mays Sen. corner of his b____ land near the run of the Pine Logg Swamp then runnng S 76 deg. E 122 poles to a stake Mays other corner then with Mays other line S 68 poles to a pairoaks said Mays other corner of his b____ land then along the other line of said land S 80 degrees E 61 poles to a stake and large pine Rilands corner then runing one of the dividing lines N 30½ degrees west 224 poles to a run of the Pine Logg Swamp then down the run and windings of the swamp opposit of the beginning then south 76 degrees E to the begining including the dwelling house and orchard. Containing 64½ acres of land valued at £60.15.0. brought forward £60.15.0 Lot No. 1 Jacob Joiner and wife to pay Elizabeth Tison the sum of £11.2.7½ Lot No. 1 Jacob Joiner and wife to pay Bowen Tison No. 3 1~3~6¾ -------------- equal share 48~8~9¾ Lott No. 2 We have laid off set apart unto Tempy Tison daughter of said dec’d her share in the following manner: Begining at a stake by a large pine Benoney Rilands corner in Mays line and the fourth corner at Lot No. 1 then runing Riland’s line N 21 E 82 poles to the center of four trees in a pond then from the four oaks in a pond we run N 38 degrees west 224 poles to the run of the Pine Logg Swamp it being a dividing line between Tempy Tison and Bowen Tison then down the run and windings of the Pine Logg Swamp to a pine the upper corner of Joiners lot then his line S 30¼ degrees E 224 poles to the beginning containing 68½ acres of land valued at 15/ per acre. £51.7.6 Lott No. 2 Tempy Tyson to pay lot No. 3 Bowen Tison the sum of 2.18.8¼ --------------- proportion 48.8.9 ¾ Lott No. 3 We have laid off & set apart unto Bowing Tison one of the heirs of said dec’d his share as followeth: Beginning at a small oak on Rilands line in the center of four trees Tempy Tisons corner then runing her line N 38 degrees west 224 poles to the run of the Pine Logg Swamp then with the run of the Pine Logg Swamp to where the little branch emties into said Pine Logg Swamp then up the run of Little Branch and windings thereof, it being a dividing line between Joab Tison and said heirs to the land said branch to a pine a dividing corner between Abraham Tison, Joab Tison and Benoney Riland then Rilands line south 21 W to the beginning containing forty one acres and three fourths valued @ 20/ per acre £41.15. Honor Tison widow to pay Elizabeth Tison minor the sum of £66.2.2¾ to make her proportion equal in value of the negroes.
