Pitt County, NC - Will & Estate Records File contributed to USGenWeb Archives by James Shivers Transcribed by James Shivers 2002 from copy on file in the Memphis, Shelby County Microfilm Archives attached to Benjamin Shivers probate record #419 1840 In the name of God Amen Know all persons that I Sarah Elks of the County of Pitt and State of North Carolina, being in a moderate state health and of sound mind and memory blessed by god for it, Knowing the uncertainty of human life and conscious of my advanced age that my departure draweth nightoss make this my last will and that is to say first I bequeath my soul to God who gave it and my body to the dust from where it came Secondly often all my just debts are paid doth give and bequesath to my son William Elks one negro boy by the name of Amos and one bay mare Item I give and bequeath unto my daughter Nancy Shivers one negro man by the name of Ned one negro woman by the Airy one negor woman by the name of Celi to her and his heirs forever I give and bequeath unto my grandson William Elks one feather bed and furniture item I give and bequeath unto my granddaughter Patsy Ann Elks one feather bed Item I give and bequeath unto my granddaughter Item I give and bequeath unto my grand daughter Amy Caroline Shivers one featherbed and furniture Item I give and bequeath unto my grand daughter Sally Buck one featherbed and furniture Item I give and bequeath unto my three grandchildren Sally Buck Randolph Bright and Gatlin Bright two hundred dollars to be equally divided between them as for the part which shall depend to Gatlin Bright to remain in the hands of Benjamin Shivers in trust for him till he becomes twenty one years of age and perhaps Gatlin Bright should die fbefore he is twenty one years dies and having no lawful heir of his body then his part of this money to be divided between Randolph Bright or his children & Sally Buck or his children Item I give unto my grand son William Elks one Cow & Calf Item I give unto my grand daughter Patsey Ann Elks one Cow and Calf All of my property which is not mentioned in this will I leave to be equally divided between my son William Elks and my daughter Nancy Shivers I now appoint my son in law Benjamin Shivers my Executor to this my last will and testament revoking all other wills by made in testamony here of Jhaire hereunto set my hand seal this the 1st day of November 1831.
