Fain and others Registered March 7th 1855 This indenture and agreement made and entered into this, the 6th day of March in the year of our Lord, One Thousand eight hundred and fifty five by and between Stephen SCARLETT and Abraham SCARLETT of the one part, and Samuel N. Fain, James P. Swann, and William W. Dean of the other part, all of Jefferson Co., Tennessee. Witnesseth that for and in consideration of having the mineral and ores in the hand herinafter tested and developed and for and in consideration of the trouble and expenses of having the title to the lands herin mentioned and researched, settled and gaining possession thereof, the said Stephen SCARLETT and Abraham SCARLETT have and by these presents do bargain, sell and convey unto the said Samuel N. Fain, James P. Swann and William W. Dean, their heirs and assigns forever, a joint and several interest and right and title with the said Scarletts of in and to all of the ores and minerals and substances on or in the lands lying and being in the County of Randolph in the State of North Carolina adjoining the lands of John SCARLETT and others and being the same lands of which Abraham HASKET died------- and possessed and which he willed by his will dated the 17th day of December 1817 to his wife Jemima HASKET during her life time and after her death to Orphelia SCARLETT, and for a particular description of said lands refferenced (sic) is hereby made to the title papers of said Abraham HASKET now of record in the proper offices in said County of Randolph and in the said State of North Carolina. The said SCARLETTS hereby also grant unto the said Fain, Swann, and Dean a joint and several interest, right, and priveledge, and a right and priveledge in common to enter upon said lands and search and take the ores and mineral substances therefrom and also the right to take and use for all mining or-------------purposes; all necessary wood off of said lands and timber therefrom to have and to hold the said right to all of said ore or mineral sobstances and the other right and priveledges nerin before mentioned unto the said Samuel N. Fain, James P. Swann, and William W. Dean, their heirs and assigns will and do warrant and do forever defend the rights and titles and priveledges herin before sold and granted against all titles or claims and covenant with the said Fain, Swann, and Dean that they have a good right and title to said land, and a right to make this conveyance in testimony whereof the said SCARLETTS have here unto set their hands and seals this 6th day of March 1855. NC, To Samuel N Fain, James P Swann, and William W Dean, by Brothers Abraham and Stephen Scarlet. By 1855 Stephen and Abraham Scarlet were settled in Jefferson Co.,TN. Their Parents, John and Orphelia Hasket Scarlet had passed away in Barren Co., KY.
