Sarah Thornburgh To Soloman WALL indenture (transcribed by Tim Walls from copy of microfilmed original on March 30, 2000) Book 19, p. 183 This Indenture Made the 12th day of the tenth Month of the year of our Lord one thousand Eight Hundred and thirty two Between Sarah Thornbrough of the County of Randolph and State of North Carolina of the first part -- Joseph Newlin of the County and State aforesd of the second part and Solomon Wall of the County and state aforesaid of the third part -- Witnesseth -- Wherein the said Sarah Thornbrough is Justly Indebted to the said Solomon Wall in the Sum of one hundred & one Dollars and thirty five Cents due by Note baring the date of this Obligation or Indenture and whereas the said Sarah Thornborough is honestly desirous to indemnify, Secure and Save harmless the above mentioned Solomon Wall in the promises therefore this Indenture Witnesseth that the said Sarah Thornbrough for and in Consideration of promises and for the further Consideration of one dollar to her in hand paid the receipt and payment is hereby duly Acknowledged hath granted bargained and Sold and by these presents doth grant bargain and Sell unto the said Joseph Newlin, his heirs, Executors administrators and Assignees the following personal property Namely 1 Dresser and furniture thereto belonging one poplar Chest two one Duch oven & lid. One Skettel, one chair two cows also the following Real estate (to wit) one plantation whereon I Now live supposed to contain Ninety one Acres More or Less - whose bearings and distances as follows - Beginning at a hickory thence south fifty four chains 184 Stone thence west fourteen and eighty one links to a stake, thence North Seventy Six chains fifty links to the old line, thence four chains & fifty links to a persimon in said line, thence South twenty two chains and fifty links to a Stake thence east to the Beginning to have and to hold the said Description and Spires of property and each of them to the said Joseph Newlin his heirs Executors Administrators and Assignees absolutely and forever in trust and Confidence Nevertheless and for the use intents and purposes hou??. after Mentioned and for no other, that is to say if the aforesaid debt of one hundred and one Dollars & thirty five Cents due to Solomon Wall by Note and that if the said Said Sarah Thornbrough Should fail or Neglect to Satisfy or any part thereof at the request of the said Soloman Wall then it shall and may be Lawful for the said Joseph Newlin after advertising the time place and terms of Sale for twenty days in at least three public places to proceed to Sell to the highest bidder for ready money as much of the aforesaid property as may pay the Costs and offences attending the Sale and registering and Recording Said deed and the amount of said note if the failure of said Sarah Thornbrough Should extend to the amount of the same or as far as the failure may extend with the Interest accruing thereon and if it shoudl be inconvenient for the said Josphe Newlin to Sell such portion of the aforesd property as would pay the prevse sum for the payment of which the sale have been made the said Joseph Newlin may sell Such other part as may be convenient and practible & return the excess above what will pay the said sum for whcih the sale was made to the said Sarah Thornbrough or her legal representative but in Case the said Note shoudl be punctually and fully paid by the said Sarah Thornbrough at the request of the said Solomon Wall then this Indenture and every Clause thereof shall be utterly void and of no effect -- In Witness whereof the said Sarah Thornbury & Joseph Newlin hath hereunto set their hands and fixed their seals the day and yaer above written Signed Dated and Delivered in presence of Leonard Beskerdite her M.
