Wall and ............. of the County of Randolph State of North Carolina of the first part and Elihu P. Hadley of the county of Randolph and state of North Carolina of the second part: Witnesseth: That the said party of the first part, for and in consideration of the sum of One Hundred Dollars in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, has bargained and sold, conveyed and confirmed, and by these presents, doth Bargain, Sell, Convey and Confirm unto the said party of the second part his heirs and assigns, Forever, all the following described piece or parcel of land, lying and being in the County of Randolph and State of North Carolina and known and designated as follows, viz: Beginning at a stone, Brown corner and running twenty chains to stone Lees corner, thence East eight chains thirty one links to a gum, said Lee's corner thence West 34 chains and 50 links to a stone in A. W. Langston line, Thence South 2 chains 50 links to a stone in the Greensboro road, thence South with various of the road to a stone in W. Langston corner, thence South 7 chains 75 links to the beginning Sixty one acres, 61. more or less. To have and to hold the same, together with all the hereditaments and appurtenances thereunto in anywise appertaining to him the said Elihu P. Hadley his heirs and assigns Forever. And the said William Wall party of the first part doth Covenant with the said party of the second part his heirs and assigns, as follows: that FIRST, That he is the the owner, and lawfully seized of said premises. SECOND, That he has good right to convey the same. THIRD, that the same is free from all encumbrances whatever. And FOURTH, that the party of the second part his heirs and assigns, shall quietly enjoy and possess the same, and that he will Warrant and Defend the title against all lawful claims. Provided, Nevertheless, That if the said William Wall of the first part his heirs, executors and administrators, shell well and truly pay, or cause to be paid to the said Elihu P. Hadley party of the second part his heirs, executors, administrators, or assigns the sum of One Hundred Dollars according to the condition of a certain Bond of even date herewith, payable in three years from the day and date above written Then this Deed to be Null and Void: otherwise to be in full force and effect. But if default shall be made in the payment of the said sum of money, or the interest, or any part thereof, at the time herinbefore specified for the payment thereof, the said party of the first part, in such case does hereby authorize and fully empower the said party of the second part his heirs, executors, administrators and assigns, upon written notice to party of first part for (30) thirty days, that prompt payment is expected, and in default thereof, sale will be made under the powers of this Mortgage, to sell the said herby granted premises at public outcry on the premises after first advertising the same for thirty days in three public places and convey the same to the purchaser in fee-simple, and out of the moneys arising from such sale, to retain the principal and interest which shall then be due on the said Land together with all costs and charges and pay the surplus (if any) to the said party of the first part or to his heirs, executors, administrators, or assigns. Wall and Mary Wall his wife, personally appeared before me this day, and acknowledged the due execution of the annexed deed of mortgage; and the said Mary Wall being by me privately examined, separate and apart from her said husband touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband, or of any other person, and that she doth still voluntarily assent thereto. Let the same, with this certificate, be registered. This 9 day of February 1888. Wm. Branson, A Justice of the Peace North Carolina, Randolph County. The forgoing certificate of Wm. Branson, a justice of the Peace of said County, is adjudged to be correct. and sufficient Therefore, let the instrument, with the certificates be registered.
