Pinson Rd4pin@aol.com ========================================================== Will of John Elder Jr. Will Know all men by these present that I , John Elder of the county of Randolph and the state of North Carolina, farmer, being in bad health but of a sound and deposing mind and memory do make and publish this my last will and testament, hereby revoking all former wills by me at anytime heretofore made, and as to my worldly estate and all the property real, personal, or mixed of which I shall die seized and possesed onto which I shall be entitled at the time of my decease. I devise, bequeath and dispose thereof in the manner following, to wit: - first - My will is that all my just debts and funeral expenses shall by my executor, herein after named, be paid out of my estate as soon after my decease as shall by him be found convenient. second I empower my executor herein after named to sell either publicly or privately, all of my estate, real, personal and mixed, of which shall die seized and possessed , or to which I shall be entitled at my decease: and the proceeds I give, devise, and bequeath to be equally devided between and among my said sons and daughters: Lea Elder, Margaret Elder, Martin Elder, William Elder, Jabez"s Elders Heirs, Nancy J. Royals and Emily Royals , counting the notes I hold at my death against my heirs as so much money by them recieved toward their equal share. And lastley: I do nominate and appoint my son Lee Elder, to be the executor of this my last will and testament . In testamony who myself the said John Elder have to this my last will and testament , I have sub- scribed my name and affixed my seal This the 11 th day of March AD 1886 Signed John Elder seal Signed, sealed, published and declared by the said John Elder as and for his last will and testament in the presence of us, who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto. Signed John Thomas Arnold James Eugene Lanier certificate North Carolina - Randolph County. It is considered and ajudged by the court that the foregoing paper writing and every part thereof is the last will and testament of John Elder deceased. And the said with the foregoing examination and application together with this order, are ordered to be recorded and filed . Let the executor therein named qualify according to law.
