Questions email me at twwalls@prodigy.net 178 May Term 1810 Cono Know all men by these presents that I Joseph Macey of Center in North Carolina in Guilford County being of Sound mind and memory and calling the uncertainilty of this life and knowing it is appointed all men once to die do make and appoint this to be my last will & testament in following Manner. First my will is that all my just debts that I shall owe to any person or persons at the time of my decease be well and truly paid and satisfied together with my funeral charges within convenient time by Executors who I Shall hereafter name. I give and bequeath to my beloved wife Mary Macey my homestead and the income of all my personal estate and what notes of hand and book debts I Shall leave behind of every Kind and quality whatsoever during her natural life and at the decease of my wife my will is my daughters such of them as Shall live Single Shall have the use of my plantation whereon I now live during their living so with privilege of cutting what rail timber and fire wood is necessary afterwards to go amongst the boys. Item I give and bequeath to my four Sons namely Joseph Macey, William Macey, Albert Macey, and Reubin Macey all my real estate together with my Smith tools and any carpenters tools and farming geers part and part alike to them & their Heirs forever all to be apprised by a lawful apprisal on account of Joseph so that if he or his Hiers ever return he may have what is belonging to him William and Albert to have land where they have settled in it To be apprised all acerage it to be in lo position it was in when they Settled in it and if Joseph never returns nor Hiers my will is that the other three boys namely William Macey, Albert Macey, 179 And Reubin shall have part and part alike to them and their Heirs forever. Further my will is that my daughters them that are behind as to filling out shall be made up equal to them that has had the most out of personal estate after that my will is that remaining part of my personal estate Shall be equally divided amongst my Six daughters Elizabeth, Mary, Rhoda, Hannah, Phebe, and Judith part and part alike to them & their Heirs forever. Further my will is that my daughters them that are behind as to filling out Shall be made equal to them that has had the most out of my personal estate after that my will is that the remaining part of my personal estate Shall be equally divided amongst my Six daughters namely Elizabeth, Mary Rhoda, Hannah, Phebe & Judith part and part alike to them and their Heirs and assigns forever. And inasmuch as the boys has all the land given them my will is that my four Sons Shall make out to their two help--ss Sisters Mary and Judith Macey fifty dollars apeice in money or what will answer as well.
