RANDOLPH COUNTY, NC - WILLS - Whitson Russell, 4 Feb 1863 --------------¤¤¤¤¤¤-------------- Last Will and Testatment February 4, 1863 I, Whitson Russell of the County of Randolph and state of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existance do make and declare this my last will and testament in manner and form following that is to say First my executor shall pay all just debts out of the moneys that shall first come in as a part of my estate. Item first I give and devise to my beloved wife Diza Russell all of my lands. Item second I give and devise to my beloved wife Diza Russell all of my horses moirls waggens gears and my buggy and all of my farming tools and all my cattle hogs and sheep and all of my house hold and kitchen furniture and all of my blacksmith tools and all of my grains of all kinds and all of my fodder, hay and rufage of all kinds. Item third I give and devise to my beloved wife Diza Russell my negro man David and all of my moneys notes and accounts all this I will to my beloved wife Diza Russell during her lifetime or widowhood at her death or when she seases to be my widow I want all my property to be divided equally amongst my children. I empower my executor to sell my negro man David that is if he should get to be disobedient to my wife Diza Russell He shall be sold at public sale and the money put at interest until a division of the balance of my property is maid amongst my children. And lastly I do hereby constitute appoint my trusty friend Wilson Russell my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof here by revoking and declaring utterly void all other wills and testaments by me here to fore maid in witness where of I the said Whitson Russell do here unto set my hand and seal this fourth day of February 1863.
