Being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in maner and form following that is to say. First that my executor hereinafter name shall provide for my body a decent burial suitable to the wishes of my relations and friends pay all funeral expenses together with my just debts who soever and to whomsoever owing out of the moneys that may first come into his hands as a part or parcelof my estate. Item I give and devise to my son Alfred CHAVISE and my daughter Alvina Jane CHAVISE all my lands tow tracts containing tow hundred and fourty seven acres to be equaly devided between them to have and to hold to them their heirs in __ simple forever. Item I give and bequeath to my son Alfred CHAVISE and my daughter Alvina Jane CHAVISE all my personal property including my house hold kitchen furniture together with all my stock of every kind, the growing crop and the provisions on hand at my death my wagons and farming tools of every description to be equally devided between them to have and to hold to them and their heirs forever. Item I give and bequeath to my son Nicholas P. CHAVISE the sum of one dollar to be payed by my executor within two years from the time of my death out of any moneys belonging to my estate not otherwise disposed of. Item I give and bequeath to my son Thomas CHAVISE the sum of one dollar to be paid by my executor within two years from the time of my death out of any moneys belonging to my estate not otherwise disposed of. Item I give and bequeath to my son Josiah CHAVISE the sum of one dollar to be paid by my executor within two years from the time of my death out of any moneys belonging to my estate not otherwise disposed of. Item I give and bequeath to my son Robert CHAVISE the sum of one dollar to be paid by my executor within two years from the time of my death out of any moneys belonging to my estate not otherwise disposed of. Item I give and bequeath to my daughter Virena WALKER, wife of Franklin WALKER, the sum of one dollar to be paid by my executor within two years from the time of my death out of any moneys belonging to my estate not otherwise disposed of. Item my will and devise is that all the residue of my estate if any after taking out the devises and legacies above mentioned shall be sold and the debts owing to me collected and if there should be any surpulus over and above the payment of debts expenses and legacis that such surplus shall be equaly devided and paid over to my son Alfred CHAVISE and my daughter Alvina Jane CHAVISE in equal potion to them and their heirs forever. And lastly I do hereby donstitute and appoint my son Alfred CHAVISE my lawful executor to all intents and purposes to execute this my last will and testament acording to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made in witness whereof I the said Thomas CHAVISE do hereunto set my hand and seal this the 19th day of November AD 1873. his Thomas (X) CHAVISE seal mark Signed dealed and published and declared by the said Thomas CHAVISE to be his last will and testament in the presents of us who at his request and in his presence do subscribe our names as witnesses thereto.
