Bowden from James Bowden & wife This indenture made and entered into this 18th day of March one thousand eight hundred and fifty between James Bowden and his wife Jane of the State of Mississippi and Nathan T. Bowden of Richmond County and the State of North Carolina on the other part. Witnesseth that the said James and Jane Bowden have for and in consideration of the sum of two hundred dollars to us in hand paid by the said N. T. Bowden the right whereof is fully acknowledged have bargained and sold and by these presents do bargain and sell and convey unto the said John a certain tract or parcel of land lying and being in the County or Richmond in the State of North Carolina lying on the waters of Big Buffaloes Creek on both sides adjoining the lands of P. M. Powell and others being a part of the lands which Howell Green died, seized and possessed of in the County and State aforesaid and which fell to us in the division of his estate. Beginning at a pine on the North side of said creek P. M. Powell’s corner and runs with Patience Baldwin’s line N’ 28 East 100 poles to a stake by a Post oak pointer than as her other line N 35 East 32 poles to the corner of the land of the said Howell Green laid off to Garrot Parker and wife thence with their line South 176 poles crossing said creek to said N. T. Bowden’s line thence with his line South 40 W to P. M. Powell’s corner thence with said Powell’s line crossing said creek to the beginning. Containing forty five acres more or less to have and to hold all the aforesaid lands together with all the singular appurtenances thereunto belonging. We the said James Bowden and wife Jane do forever warrant and defer from us our heirs, Executors, administrators and assigns and from all the lawful claims of any and all other persons whatsoever unto him the said N. T. Bowden his heirs, executors, administrators & forever. In testimony whereupon we have hereto set our hands and seals in the presence of us who have bear subscribing witness to the same. Know ye that we confiding to your prudence and fidelity we have appointed you commissioners and do by these presents authorize and request you to examine James Bowden and his wife Jane Bowden and require them to State directly whether they signed sealed and delivered a deed hereto appended and made by the said James Bowden and Jane Bowden to Nathan T. Bowden of Richmond County and State of North Carolina and whether said deed was executed by them as their act and deed . And your further directed to examine the said Jane Bowden Separate and apart from her husband the said James Bowden and require her to state distinctly whether she executed said deed fully without any force threats or compulsion of her said husband and whether she thereby extinguishes her claim to dower in the land tenements as described in said deed. Such examination you are to certify under your hands and Seals. Witness the Honorable James Rogers, Judge of the Probate Court of said County which said court is a court of record the fourth Monday in February, 1850 and the seal of the said court affixed issued the first day of March 1850. Gatlin Commissioners appointed by probate Court of Said County Jane Bowden wife of James Bowden whose name appears to the written deed of conveyance made to Nathan T. Bowden and being interrogated separately and apart from her said husband says that she assigned the written deed of conveyance of her own free and voluntary choice and not from any fear of compulsion on the part of her said husband James Bowden or any other person heard in the presence of the above named commissioners done this 15th day of March, 1850.
