This file was contributed for use in the USGenWeb Archives by: Marsha Crouch Hulsey LaVaye@aol.com ==================================================================== Last Will and Testament of Samuel Crouch (d. 1864) I Samuel Crouch of the County of Richmond and State of North Carolina being of sound mind and disposing memory, but considering the uncertainty of my Earthly existience, do make this my Last Will and Testament in manor and form following, That is to say: Item First My will and desire is that my Executor hereinafter named, shall provide for my body a decent burial, and pay all my funeral expenses together with all my just debts, out of the first money that may come into his hand, as part or parcel of my estate. Item 2nd I give and bequeath unto my beloved wife Abigail one negro girl, by the name of Catherine, one bed and bedstead, one under sheet, one double woven counterpane, one bed quilt, one red double woven blanket, one trunk, and my bay mare. I also give unto my wife after my death for her years support, 3 hogs her choice and forty bushels of corn and ten bushels of wheat. My will and desire is that my wife shall have the use of my negro man Terril and blacksmith shop for 4 years after my death in case she shall live 4 years after my death. My will and desire is that at the expiration of 4 years after my death or at the death of my wife if she should die sooner than that time, that the said negro man and my blacksmith shop, shall be sold and that my Executor pay to my wife, one hundred dollars out of the proceeds of the sale of the said negro man and blacksmith shop - the balance of the money to go as the rest of my estate. Item 3rd I give and bequeath unto my daughter, Nancy Skinner, the sum of 6 hundred dollars together with the 2 hundred which I gave her in my lifetime. Item 4th I give and bequeath unto my grandson, James Chappell, one hundred dollars. Item 5th I give and bequeath unto my grandson, Eli Chappell, the sum of one hundred dollars. Item 6th I give and bequeath unto my grandson, Parks Chappell, the sum of one hundred dollars. Item 7th I give and bequeath unto my grandson, Morris Chappell, the sum of one hundred dollars. I give and bequeath unto my granddaughter, Clementine Capel, the sum of one hundred dollars. I give and bequeath unto my granddaughter, Rody Baldwin, and the children of my granddaughter, Marthena Covington, who is now dead, a note which I hold against my son James Crouch of 2 hundred dollars, to be divided between them, that is Rhody Baldwin is to have one hundred dollars, and the children of my granddaughter Marthena Covington the other hundred. I give and bequeath unto my granddaughter July Ann Baldwin the sum of one hundred dollars. I give and bequeath unto my granddaughter Erandy Covington the sum of one hundred dollars. I give and bequeath unto my granddaughter Mary Chappell the sum of one hundred dollars. My daughter Olive, who intermarried to Nelson G. Chance has had her full share. I therefore give unto her, what she has already had and no more. I give and bequeath unto my daughter Sarah Webb the sum of 8 hundred dollars. I give and bequeath unto my daughter Elizabeth Ballard the sum of one hundred and 30 dollars, to be paid her out of my estate and the sum of 6 hundred and twenty dollars, which I have heretofore paid her which will make 8 hundred in all her equal share. I give and bequeath unto my three grandchildren, the children of my daughter, Susan Slaughter deceased, the sum of 8 hundred dollars to be equally divided among them share and share alike. I give and bequeath unto my grandchildren, the children of daughter Deliah Capel deceased, the sum of 8 hundred dollars, to be divided among them share and share alike. I give and bequeath unto my grandson, Robert W. Capel the sum of one hundred dollars. My son James Crouch has had his full share of my estate, therefore I give him no more. I give and bequeath unto my Joseph Crouch a negro boy by the name of Owen, which will be his full share, with what he has heretofore had. I have given to my son Samuel C. Crouch a deed to my lands, where I now live, after my death which will be his full share of my estate. My will and desire is that after my death, that my Executor herein after named, shall sell at Public sale, on such a credit as he may think best, all of my negroes, my stock of horses, mules, hogs, cattle, household and kitchen furniture, crops of every description, and every other article of property which I have at my death, except what I have disposed of in this will, and the moneys arising from such sales after paying off my just debts, and all the expenses of my estate and all the legacies that I have given and bequeathed, if there should be any more money remaining, in the hands of my Executor, than will pay off the foregoing legacies bequeathed by me, my will and desire is that the remainder of any be equally divided between my daughters that is living and the children of my daughters that is dead share and share alike equally except my daughter Olive Chance and in her case, if there is any thing coming to her in a final settlement of my estate, my will and desire is that my executor will pay my daughter Olives part over to my granddaughter, Sarah Ann who is intermarried to Daniel or David? Green. And lastly I do hereby constitute and appoint my trusty friend Isaac Ewing my lawful Executor to all intents and purposes to execute this my last will and testament, according to the true intent and meaning of the same every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments heretofore made by me. In witness thereof I the said Samuel Crouch do hereunto set my hand and seal this 6th day of November in the year of our Lord One Thousand Eight hundred and Sixty Three. Signed Sealed and Published by the Said Samuel Crouch to be his last will and testament in the presence of us, who by his request do witness the same. John W. Ewing David Parsons Seal (His Mark) Codicil of the Foregoing Will I Samuel Crouch will and desire that if I should die during the year that my hands should remain on the land in which I now live and make a crop and that said crop shall be sold and divided among my children and grandchildren, the grandchildren of each of my deceased children to have an equal share or their mothers or fathers part. I also desire that the boy Terril loaned to my wife for 4 years shall be loaned to her during her natural life and then disposed of as heretofore provided. Ewing Seal (His Mark) North Carolina Court of Pleas & Quarter April 1864 County of Richmond Sessions A paper writing proporting to be and contain the Last Will and Testament of Samuel Crouch deceased, is exhibited for probate in open court by Isaac Ewing, Executor therein named and the due Executor through by the said Samuel Crouch is proven by the courts and examination of John Ewing and David, Daniel? Parsons, the subscribing witnesses thereto and the due execution of a writing thereunto appended proporting to be a Codicil to the said Last Will and Testament or proven by courts and examination of Nathan T. Bowden and John W. Ewing the subscribing witnesses thereto. It is therefore considered by the Court that the said paper writing and every part thereof together with the said Codicil and every part thereto is and are the Last Will and Testament of the said Samuel Crouch deceased and the said Last Will and Testament together with said Codicil thereto as a part thereof is ordered and recorded and filed and therefore the said Isaac Ewing Executor is aforesaid duly qualified as said by taking the oath required by law. ?.
