Last Will and Testament of Samuel Pate – 7th November 1841
State of North Carolina. Richmond County. In the name of God Amen, I, 
Samuel Pate of said county being weak in body, but of sound and 
disposing mind and perfect memory considering the uncertainty of this 
mortal life do make and constitute this my Last Will &Testament in 
manner and form following (that is) I will and bequeath unto my beloved 
wife Marthew one hundred and fifty acres of land including my dwelling 
house and cleared land so much of said cleared land as will admit of 
fifty acres of woodland for rail timber and firewood. Said fifty acres 
will be allowed to be laid off north of my plantation on each side
of the publick (sic) road runing (sic) near my house. In all one 
hundred and fifty acres as above stated. Also one Negro boy by the name
of York and also one Negro girl by the name of Christian, also one 
sorrel horse named Damon, one saddle and bridle, two plows and two 
weeding hoes and one ax. Also two feather beds and furniture and one 
spining (sic) wheel and two cows and calves, all my crockery ware, 
knives and forks, cooking utentials (sic), tubs, pails, one table and 
two bedsteads during her naturl (sic) life and after the death of
my said beloved wife, I order all the above specified property to be 
eaqualy (sic) devided amongst the heirs of my body which will be 
hereafter named.
All The ballance (sic) and residue of my lands and Negroes, horses, 
cattle, sheep and hogs, waggon cart and every other spices (sic) of 
property not previously need in the bequeath to my wife I order to be
eaqually (sic) devided (sic) and apportioned between the lawful heirs 
of my body, namely, Ann, Elias, Samuel & Marthew the childring (sic) of
my son Thoragood dec'd to have the (turnover) portion that would of 
been his if he had lived. The childring (sic) of my daughter Hester to 
have the portion that would have been hers, had she lived.
The manner and mode of deviding (sic) the property bequeathed to my 
childring (sic) will be left intirely (sic) to themselves hoping they 
will not disagree.
I appoint and ordain my son Samuel Pate sole executor of this my last
will and testament which hereunto I set my signature or mark and affix 
my seal in the year of our Lord one thousand eighthundred and forty 
one. November the 7th. Signed &sealed in
the presents of S. Goodwin, Hugh Livingston & Duncan Smith.
