Wills, Philemon Thomas, 1797: Written: 1797 “I, PHILEMON THOMAS, of the County of Richmond in North Carolina, being weak in body but of sound mind, do make and ordain this as my last will and testament with respect to such worldly goods as it hath pleased God to bless me with. That is to say:” “1st, I leave to my wife ELIZABETH during her natural life, my dwelling house and plantation on the south side of Cartledge Creek, with the third part of my land adjoining thereto.” “2nd. All my other lands, I will to be equally divided between my five children: Elijah, Eli, James, Nathan and ELIZABETH, to them and their heirs and assigns forever, and after my wife’s death, I will that the plantation and lands before given to her during her lifetime be equally divided between my five said children in the same way as my other lands are.” “3rd. I give and bequeath unto my son, Elijah, when he shall arrive at the age of twenty-one years, one negro woman named Luce.” “4th. I give and bequeath unto my son Eli, when he shall arrive at the age of twenty-one years, one negro man named Harry.” “5th. I give and bequeath unto my son James, one negro man named Jack, when my said son James shall arrive to the age of twenty-one years.” “6th. I give and bequeath to my son Nathan, when at the age of twenty- one years, one negro boy named Tony. My negro boy named Ned I leave to wife during her natural life, and after her death, I give him to my daughter, ELIZABETH. But if my wife should think it more for the interest of herself and of my said daughter, ELIZABETH for to exchange the said boy Ned for a female slave, then in that case, I hereby give her full power so to do, and the female slave so exchanged for to go and descend in the same way as Ned is before mentioned to go and descend.” “7th. For the support and education of my small children, I will the use and profit of my aforementioned negroes until my aforementioned sons arrive to the age of twenty-one years, to which the said negros are respectively willed together with such other part of my personal property as my Executrix and Executors hereafter named shall judge necessary for the support and education of my said small children.” “8th. To my wife, I will one third of the residue of my personal property forever, and the other two thirds to be equally divided between my five said children: Elijah, Eli, James, Nathan and ELIZABETH (my other children having already received their part of my estate.) [These other children were from a previous marriage, wife unknown.] 9th. And I do hereby ordain and appoint my beloved wife Executrix, and my son William and my son Nathan as executors to this, my last will and testament.
