State of North Carolina } In Equity Robeson County { Fall Term 1858 To The Honorable the Judge of the Court of Equity for the County and State aforesaid. The Bill of Complaint of Daniel Little and his children Margaret Ann Virginia Little Mary Carolina Little & Eliza Jane Little Minors by their next friend Daniel Little. Against Archd Buie, Duncan Brown & wife Sally Ann, Malcom Buie, Daniel McP Buie Flora Buie, Neill Buie, John Buie, Neill McNeill & wife Annabella & Effie Buie, Neill McCorvey & wife Mary. Your Orators humbly complaining Show unto your Honor that Daniel Buie Departed this life Intestate in 1823 Seized & posseSsed of about 1300 acres of Land That he left him surviving as his heirs at Law Archibald Buie, Sally Ann Buie, Malcom Buie, Mary Burie, Daniel McP Buie, Neill Buie, Annabella Buie, John Buie, Effie Buie & Rebecca Buie, and his widow Flora Buie. That Sally Ann Buie intermarried with Duncan Brown, Mary Buie with Neill McCorvey, Rebecca Buie With your orator Daniel Little. That Archy, Malcom, Daniel McP Buie, Duncan Brown & wife Sally Ann, Neill McCorvey & Mary his wife by proper conveyances have conveyed their several interests in said Land to Flora Buie the widow of the Intestate. That Neill Buie, Effie Buie, John Buie, Neill McNeill and wife Annabella are still alive and have not parted with their interest in said Land, and as ------------------------------------------------------------------ Tenants in Common with Flora Buie the widow of the Intestate, and with your Orators & Oratrixes. That many years ago Rebecca the wife of your or- ator Daniel Little died leaving the said Daniel, and and her son Daniel B. Little her heirs at law. That the said Daniel B. Little departed this life On the 19th April 1858 aged about twenty years, That previous to the death of the said Daniel B Little your Orator Daniel Little had intermarried with Mary Evans, and that the death of his son Daniel B. had born to him and living a Daughter named Margaret Ann Virginia, who was a half sister to the Deceased Daniel B. That in about a month after the Death of the said Daniel B. Your Orator Daniel had born to him two Daughters viz: Mary Carolina and Eliza Jane both of Whom together with Margaret Ann Virginia, are half Sisters to the Deceased Daniel B. Little who was son of your Orator & his Deceased wife Rebecca. Your Orators & Oratrixes show unto your Honor that the said half sisters are the heirs at Law of their Deceased half Brother, and as such are entitled to his interest in said Land after the termination of your orator Daniel Little Estate as Tenant by the Curtesy. Your Orators further show until your Honor that Dower has been allotted to Flora Buie widow of the Intestate out of said Land, leaving acres subject to partition among the Tenants in Common. That Flora Buie is entitled by purchase to 5/10th, Effie Buie To 5/10th, Neill Buie to 5/10th, John Buie to 5/10th, Neill McNeill & wife Annabella to 5/10th, & Your Orator & Oratrixes to 5/10th, Your Orators & Oratrixes therefore pray your Honor that Commissioners may be appointed to make partition of said Land in manner & form as the Law directs ---------------------------------------------------------------------- That your Orators & Oratrixes interest in said Land may be declared. That a copy of this Partition together with a sub poena be served on Flora Buie, Effie Buie, Neill Buie, John Buie, Neill McNeill & wife Annabella returnable before your Honor in this Honorable Court. And that publication be made for Duncan Brown & wife Sally Ann, Neill McCorvey & wife Mary and Malcom Buie who are nonresidents and living beyond the limits of the State And that your Honor may grant to your Orators & Oratrixes such other and further reliefs as to your Honor shall seem meet & proper, and your Orators as in duly bound will ever pray Banks A true Copy R S French CMM Eq.
