            To the worshipful the Justices of said Court the petition of James
A Rozier of Robeson County showeth unto Your worships that he believes Henry
Byrd to be a lunatic And that he has been a lunatic for the last three Years
And he prays Your worship to order a writ to be iSsued to the sheriff of
Robeson County commanding him to summon a Jury to inquire of the
lunacy of the said Henry Byrd and report to this Court.  That Your wor-
ships Shall make such other & further orders in his case as to Your
worships shall seem proper & meet and Your petitioner shall ever pray

   Ordered by the Court that a writ of inquisition of lunacy issue as
Prayer for
State of North Carolina }
Robeson County          {  To the sheriff of Robeson County Greeting
You are hereby commanded to summon a Jury of twelve good and lawful
men, freeholders to assemble and after being duly sworn & impanneled to
inquire & try wheather or not Henry Byrd is a lunatic and if so for how long on
time and return their proceedings under their hands & seals to this term of the
Court that the same may be considered of and such action taken as shall be most
& proper And You shall further made known unto the court now You shall have
executed this writ & this You shall in no wise omit under the penalty prescribed 
by act of aSsembly:  WitneSs John A. Rowland Clerk of the Court of Pleas & Quarter 
SeSsions of Robeson County as office Febt 22 1864     Jno A Rowland Clk
            I have executed this writ by summoning the following Jurors to wit
Berry Godwin, Jno B. Thompson  Durham Lewis Jno Isreal Jacob Thompson  Griffin 
Hill  Grady  H Floyd Chas Ivey Wm Prevatt Jno T Pope Alex McMillan Hugh Dallas   
R King Shff
            We the undersigned Jury Summoned by the sheriff of Robeson County in 
the above case find that Henry Byrd is a lunatic and has been a lunatic and of 
unsound mind for the last three Years.  Given under our hands and seals having 
been duly sworn and enpanneled according to law the Feby 23 AD 1864

On motion, It is ordered by the Court that James A Rozier have
leave to file a petition to the Court to ascertain by the inquisition of a
Jury to be summoned by the sheriff by virtue of a writ issed for that pur-
pose whether Henry Byrd of Robeson County be a lunatic of sane mind

Comments:  Henry Byrd lived in northeastern Wishart Township near the Big Swamp 
and Jackson Swamp.  He was a son of William Byrd and wife Martha Parker Byrd.  He 
was married to Helen Rozier of Robeson Co NC.
