Also three negroes, to wit: JO, FED and PATIENCE; stock of Cattle, Horses, Sheep and Hogs; one still and a large wagon. In this case, it appearing to the satisfactiion of the Court that the Defendant, ARCHIBALD FAIRLEY, is not a resident of this State. It is therefore ordered by the Court that publication be made for three months in the North Carolina Journal, printed in Fayetteville, notifying said Defendant to be and appear at oour next term of the Superior Court of Law to be held for the County of Robeson at the Court House in Lumberton on the fourth Monday in March next. Then and there to plead, answer or demur to this petition filed. Otherwise judgment will be taken pro confesso and the matter head ex parte as to him.
