French one of the Judges of the SeSsion Courts of Law and Equity of the state aforesaid in the petition of James Mercer respectfully showeth unto your Honor that he is a shoe maker by trade – habitually employed in working for the public that he is skilled in his said trade ~ and that he has been engaged in making shoes for the public for more than ten years. Your petitioner Showeth to your Honor, that notwithstanding he was Exempt from Conscription by virtue of his trade ~ Yet on the 3rd day of September last, he was enrolled as a Conscript by one William M. Swann notwithstanding he presented his Case truly to the said Swann and placed in the custody of Col. Morisey ~ with the view of lending your petitioner to the Camp of Concription as trade he Your petitioner further showeth unto your Honor that he is now in the Custody of Maj. W. F. French, who notwithstanding he is exempt from Conscription by virtue of his trade intends to send your petitioner to the Camp of Conscription at Raleigh. Therefore Your Petitioner prays your Honor to grant to him the writ of Habeas Corpus to be directed to the Said Major Wm. F. French requiring him to bring before your Honor the body of Your petitioner with the Cause of his Captain & detention ~ that the same may be inquired into & relief may be afforded to your Petitioner. Mercer, Sr. was a son of Rowland Mercer, Sr. and first wife Ora Smith Mercer of Wishart’s Township in eastern Robeson Co NC. He was born in 1822 and died in 1908. He was married to Kitsey Regan, a daughter of Ralph Regan, Sr. and third wife Elizabeth Musselwhite Regan. James Mercer was a great great grandfather of the transcriber/Submitter, Sam West.
