This file was contributed for use in the USGenWeb Archives by: Barbara Hootman ==================================================================== THE LAST WILL AND TESTAMENT OF MARY BROWN WRITTEN 1860 - PROBATED 1865 I Mary Brown of the County of Robeson and State of North Carolina being of Sound mind and memory but considering the uncertainty of my Earthily existence do declare this my last Will and Testament in manner and form following that is to Say Item first I give and devise to my Sister Catharine Buie my negro girl Effy and her three children Item Second I give and devise to my Sister Margaret McIntosh One Hundred Dollars Item Third I give and devise to my Neice Mary E. McMillan One Hundred Dollars Item fourth I give and devise to my neice Ann J. Smith my negro girl Harriet and child Item fifth I give and devise to my Brother William H. Brown my negro boys Sampson and Anthony Amy and her children except Lydia Item Sixth I give and devise to my Nephew Neill Archild Son of W. H. Brown a negro girl named Lydia Item Seventh I give and devise to my Brother William H. Brown my horse and carriage also my cattle also one Feather bed and bed clothe, also I leave my books to him I also give and devise to him thirteen Hundred and ten Dollars, also my negro man named George Item eight I give and devise to the Trustees of Philadelphius for the use and benefit of Said Church Three Hundred Dollars the Lawful interest of which shall be Paid annually to the pastor or other Stated Minister as Said church so long as Sound old Presbyterian doctrine is there Preached And lastly I do hereby constitute and appoint my Brother William H. Brown my lawful Executor to all intents and purposes to execute this my last Will and testament according to the true intent and meaning of the Same and every part and clause thereof hereby revoking and declaring utterly void all other Wills and testaments by me heretofore made In witness whereof I the Said Mary Brown do hereunto Set my hand and Seal this the 17th day of October A. D. 1860 Signed Sealed published and declared by the Said Mary Brown Mary Brown (her seal) to be her last will and testament in the presence of us who at her request and in her presence do subscribe our names as witnesses thereto ?? Robeson County August Germ 1865 This paper writing purporting to be the last Will and Testament of Mary Brown deceased is exhibited for probate in open court by William H, Brown the executor therein named. And the due executor thereof by the said Mary Brown is proven by the oath and examination of H McNeill one of the subscribing witnesses thereto. It is therefore considered by the Court that the said paper writing and every part there of is the last Will and Testament of the said Mary Brown and the same in declared to be recorded and filed, And thereupon the said William H Brown executor as aforesaid duly qualified as such by taking the oath required by law ??
